Resolution Number 83-1-18-6373 RESOLUTION NO. 83-1-18-6 FORMATION OF UNDERGROUND UTILITY DISTRICT 83-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT 83-1 WHEREAS, by Resolution No. 83-1-4-6, a public hearing was called January 18, 1983, at the hour of 7:00 P.M., in the Council Chamber, City of San Juan Capistrano, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or associated service within the land described in Exhibit "A", attached hereto and made a part of. WHEREAS, such hearing was duly and regularly held at which a report of the Director of Public Works was received and filed, and all persons interested have been given an opportunity to be heard. WHEREAS, based upon the testimony and other evidence received, this City Council has found and determined that the undergrounding of utilities is necessary to eliminate an unusually heavy concentration of poles, wires and other overhead distribution facilities on and along rights-of-way which are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. NOW, THEREFORE, BE IT RESOLVED, that Underground Utility District 83-1 be and is hereby established within the land described in Exhibit "A" attached. BE IT FURTHER RESOLVED, that all poles and overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times: 1. Underground installation by the utility companies and property owners and reconnection shall commence approximately March 28, 1983. -1- 2. Removal of poles, overhead wires, and other associated overhead structures shall be completed approximately May 23, 1983. BE IT FURTHER RESOLVED that the City Clerk within ten (10) days after the adoption of this Resolution shall mail a copy hereof and a copy of Sections 7-8.01 through 7-8.12 (Ordinance No. 146) of the City of San Juan Capistrano Municipal Code to _ affected property owners as shown on the last equalized assessment roll and to the affected utilities. MARY ANN I ER, CITY CLERK -2- Re 77 EXHIBIT "A" UNDERGROUND UTILITY DISTRICT 83-1 DESCRIPTION The land within Underground Utility District 83-1 shall consist of two parcels, described herein, and the contiguous right-of-way of E1 Camino Real and Acjachema Street. PARCEL 1 Beginning at a post in the fence corner of the north side of San Fernando Street (now Mission Street) in the town of San Juan Capistrano, which point is 70 feet distant North 22130' West from the northeast corner of the Mission lands in Lot 1, Block 1 and running thence North 22030' West along the westerly side of Main Street (now E1 Camino Real) 414 feet to post in the fence corner; thence South 70015' West along the fence 380 feet to the east line of the County Road (now State Highway); thence South 20015' East along the road fence 304 feet to the fence corner on the north line of San Fernando Street (now Mission Street); and thence North 86030' East to the Point of Beginning; and being a portion of Lot 1, Block 1 of San Juan Capistrano in the County of Orange, State of California, as per map thereof recorded in Book 3, Pages 120 and 121 of Miscellaneous Records of Los Angeles County, California.
