(AMRAN/
WHEREAS, the applicant, Amran/Tekmar, 35102 Camino
Capistrano, Capistrano Beach, California, 92624, has submitted an
application for approval of a 200 -room hotel with a convention/
banquet facility, restaurant, coffee shop and associated support
uses for a 9.5± acre parcel located on the southeast corner of
Valle Road and San Juan Creek Road; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will have a significant
effect on the environment, has required the preparation of an
environmental impact report, which report has been certified as
complete by the City Council, and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the City's Architectural Board of Review has
reviewed the project and forwarded it to the Planning Commission
recommending approval subject to certain conditions; and,
WHEREAS, the Planning Commission has reviewed the
project and, due to its relationship to General Plan Amendment
83-1 and Rezone 82-9, has forwarded it to the City Council
recommending approval; and,
WHEREAS, the City Council hereby finds and determines
as follows:
1. The project is consistent with all applicable
goals, objectives, and policies of the General
Plan as per General Plan Amendment 83-1.
2. The project, as designed and conditioned, is
consistent with all applicable requirements of
Rezone 82-9 (Precise Plan) and Title 9 (Land Use)
of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
does hereby approve Architectural Control 82-5, subject to the
following conditions:
Expiration of Approval: Per Section 9-2.305 of
the Municipal Code, this project development
approval shall expire on--i.e.,
one year from the City Council approval date. If
no building permit has been issued for the project
by that date, the development approval shall
become null and void.

2. Building Plans: Final building plans (working
drawings) shall be reviewed by the Architectural
Board of Review (ABR) and shall be approved only
if said Board determines that the working drawings
are consistent with the concept plans approved
with this Resolution.
3. Landscape Plans: Final landscape and irrigation
plans shall be reviewed and approved by the
Architectural Board of Review consistent with the
concept plans approved with this Resolution.
4. Sign Program: The project sign program shall be
subject to ABR approval during review of final
building plans (reference Condition Nos. 2 and 8).
5. Exterior Lighting: The precise plan for parking
lot and other ground- and building -mounted
lighting fixtures shall be subject to ABR approval
during review of final building plans (reference
Condition No. 2).
6. Architectural Building Elevations:
a. The elevations for the public facilities
building shall be modified incorporating
additional berming and the lowering of the
building such that it results in the exposed
wall surface as measured to the eave line of
approximately 18 feet. All towers on the
project not to exceed 35 feet, with the
exception of the tower serving the cottages
and the dome roof at the main lobby.
b. The Phase II room addition to be revised so
that the rooms on the southwesterly section
of the spine are visually reduced and would
be perceived from off-site as a three-story
element. The actual architectural treatment
to be simplified with a maximum visible
height not to exceed 35 feet.
7. Entry Design: Redesign the formal project entry
providing for a relationship to the other project
walls.
8. Sign Program Materials: The sign program shall be
revised for conformance with the Municipal Code
and of a material such as wood, wrought iron,
tile, or paint.
9. Materials and Colors: Materials and colors to be
approved during Phase III review by the
Architectural Board of Review.
10. Stucco Finish: The exterior finish shall be a
smooth trowel mission finish.

11. Roof Material: The roof material shall be a
two-piece barrel tile.
12. Public Improvements: The following improvements
shall be completed prior to issuance of use and
occupancy permits for the initial phase of
construction.
a. Improvement of Valle Road from Interstate 5
northbound ramps to San Juan Creek Road.
Improvements to include a minimum 40 -foot
curb -to -curb width with sidewalk on east side
such that it does not encroach any further
than that shown for Valle Road Alternate A.
Reimbursement agreement for 23 percent of
cost to be borne by Forster Canyon Planned
Community dependent upon timing of
construction by said development. Seventy-
seven percent of cost to be borne by
applicant (ultimate).
b. Signalization of the improved intersection of
San Juan Creek Road and Valle Road with
reimbursement agreements for 15.9 percent of
the cost by Forster Canyon Planned Community
and 39.7 percent of the cost by the Glendale
Federal Planned Community. Forty-four
percent of cost to be borne by applicant
(ultimate).
C. San Juan Creek Road shall be improved to its
ultimate width from Valle Road to the
existing ultimate width. Improvements to
consist of a full street section with
sidewalk. A reimbursement agreement shall be
executed for improvement costs associated
with the street improvements for Assessor's
Parcel No. 124-120-67 (MEB Investment).
These improvements may be constructed prior
to the present proposal dependent on the
timing for Architectural Control 82-2 (MEB
Investment) whereby said agreement shall
become null and void if completed prior to
Architectural Control 82-5.
d. Re -striping of San Juan Creek Road between
Valle Road and Camino Capistrano to include
two travel lanes in each direction with
westbound San Juan Creek Road providing
separate left and right lanes at Camino
Capistrano.
e. The applicant shall install a traffic signal
at the project entry with San Juan Creek
Road.

3 66 f. The traffic signals at the project entry and
San Juan Creek Road and the intersection of
Valle Road and San Juan Creek Road shall be
physically interconnected, with provisions
for ultimate connection with the signals for
San Juan Creek Road and Camino Capistrano and
Camino Capistrano at the southbound
Interstate 5 ramps.
g. Provide for a temporary sidewalk on San Juan
Creek Road between its intersection with
Valle Road and Camino Capistrano.
h. The applicant shall participate in the
signalization of Valle Road at the northbound
ramps of Interstate 5 for 21.3 percent of the
cost of installing the signal. Said
installation contingent upon future
construction of La Novia Avenue or extension
of Valle Road to Camino Las Ramblas by
developers of the Forster Canyon Planned
Community.
13. Other Participatory Improvements: The applicant
shall enter into agreements for participation in
other improvements as follows:
a. Applicant shall participate in the cost of
signalizing the intersection of Camino
Capistrano at San Juan Creek Road. Said
participation to be 18.2 percent for the cost
of signals and installation.
b. Applicant shall participate in the cost of
signalizing the intersection of Camino
Capistrano at the southbound ramps of
Interstate 5. Said participation to be 17.5
percent for the cost of the signal and
installation.
C. Applicant shall participate in City cost for
construction of the Camino Capistrano bridge
to a maximum 3.8 percent. City cost involved
with the bridge includes right-of-way
acquisition and design work. All
construction funding will be by the Federal
Highway Administration and County of Orange
(100 percent).
d. The applicant shall enter into an agreement
to participate in the provision of a
pedestrian/bikeway crossing of San Juan Creek
east of Interstate 5.
e. Said agreements to be executed prior to
issuance of building permits.

14. Water Facilities: Water transmission and
distribution facilities shall be designed,
constructed, and dedicated in accordance with
Section 9-4.109 of the Municipal Code and the
requirements of Orange County Water Works District
No. 4. Such distribution facilities and
appurtenances shall be approved by the County Fire
Marshal.
15. Manufactured Slopes: All manufactured slopes
shall be designed and constructed in accordance
with Section 9-3.505 and 9-4.112 of the Municipal
Code. All such slopes shall be 2:1 ratio or
flatter.
16. Other Improvements and Dedications: Driveways,
pedestrian ways, bikeways, equestrian trails,
utility undergrounding, street lights, traffic
signals, drainage facilities, and sanitary sewers
shall be located and constructed in accordance
with Article 9-4.1 (Design Standards and
Requirements) of the Municipal Code and adopted
City policy.
17. Geotechnical Report: A geotechnical feasibility
study shall be completed to determine the seismic
safety and soils stability of all proposed grading
and development within the project. The report
shall be reviewed and approved by the City
Engineer prior to issuance of a grading permit.
18. Fees: All required fees shall be paid prior to
issuance of any building permit.

OLD FIRE STATION RECREATION COMPLEX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING THE SITE PLAN FOR THE OLD FIRE STATION
RECREATION COMPLEX LOCATED AT 31411 LA MATANZA
STREET
WHEREAS, the City's Department of Parks and Recreation
has submitted a site plan for approval of the rehabilitation of
the old fire station property located at 31411 La Matanza Street
as a community recreation complex; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will not have a significant
effect on the environment, has recommended the preparation of a
Negative Declaration, which has been certified by the City
Council, and has otherwise carried out all requirements of the
California Environmental Quality Act; and,
WHEREAS, the City's Planning Commission has reviewed
the project and forwarded it to the City Council recommending
approval subject to certain conditions; and,
WHEREAS, the City Council hereby finds and determines
as follows:
1. The project is consistent with all applicable
goals, objectives, and policies of the General
Plan.
2. The project, as designed and conditioned, is
consistent with all applicable requirements of
Title 9 (Land Use) of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
does hereby approve the site plan for the Old Fire Station
Recreation Complex subject to the following conditions:
Buildin Plans: Final building plans (working

Heritage Commission and shall be approved only if
said Commission determines that the working
drawings are consistent with the guidelines
approved for buildings designated on the Inventory
of Historical Structures. Furthermore, all
modifications/alterations shall be consistent with
and compatible with the existing architecture and
historic nature of the complex.
Landscape Plans: Final landscape and irrigation
plans shall be reviewed by the Cultural Heritage
Commission and shall be approved only if the
Commission determines that said plans are
consistent with the concept plans approved with
this Resolution.

Sign Program: The project sign program shall be
subject to review and approval by the Director of
Community Planning and Development.
Exterior Lighting: The precise plan for parking
lot and other ground -mounted lighting fixtures
shall be subject to approval by the Director of
Community Planning and Development.
Occupancy Restriction: The use of the complex
shall be restricted to a maximum 112 participants
at any one time. Increasing the number of
participants above the restricted number shall be
contingent upon developing alternate transportation
modes or execution of reciprocal parking
agreements with adjacent property owners such that
sufficient off-street parking would be provided
consistent with the provisions of the Municipal
Code. Such a program shall be reviewed by the
Director of Community Planning and Development
and, upon report, approved by the City Council.
6. Water: Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of Orange
County Water Works District No. 4. Such
distribution facilities and appurtenances shall be
approved by the County Fire Marshal.
7. Other Improvements: Driveways, pedestrian ways,

facilities, and sanitary sewers shall be located
