A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING
RESIDENTIAL CONCEPT PLANS FOR GROWTH MANAGEMENT
82-1 (CAPISTRANO PARTNERS/HUNT CLUB)
WHEREAS, the applicant, Capistrano Partners, 3212
Nebraska Avenue, Santa Monica, California, has submitted
Residential Concept Plans for Lot 134, Tract 6305, proposing to
subdivide approximately 71.3 acres into 46 custom estate lots in
accordance with Chapter 9-7 of the Municipal Code (Residential
Growth Management); and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will have a significant
effect on the environment, has required the preparation of an
environmental impact report, which report has been certified as
final by the City Council, and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the Planning Commission has reviewed the
concept plan, as recommended adoption of draft growth management
point rating for the concept plan, and has forwarded said plan
and point rating to the City Council recommending approval
subject to conditions; and,
WHEREAS, the City Council, after holding a duly noticed
public hearing, hereby finds and determines as follows:
1. The growth management point rating of 50 points is
accurate and appropriate.
2. The proposed concept plan, as conditioned, is
consistent with the 1.1 Very Low Residential
General Plan land use designation and is otherwise
consistent with all other Elements of the General
Plan.
3. The proposed concept plan, as conditioned, is
consistent with the zoning on the property and
with all requirements of Title 9 of the Municipal
Code (Land Use).
NOW, THEREFORE, BE IT RESOLVED, that a growth
management point rating of 50 points is hereby adopted for the
subject residential concept plan per Chapter 9-7 of the Municipal
Code.
BE IT FURTHER RESOLVED, that the City Council does
hereby approve Residential Concept Plan Growth Management 82-1,
subject to the following conditions:
1. Tentative Tract Map - Pursuant to Section 9-7.109
of the Municipal Code, Residential Concept Plan
approval does not constitute final approval of a
project. All further requirements of Title 9 of
the Municipal Code must be satisfied for the
project to proceed.

3 J 2. Composite Development Plans - If the subject
lj parcels are granted building permit allocations
under Chapter 9-7 of the Municipal Code
(Residential Growth Management), the processing of
composite development plans and subdivision maps
shall be required. Composite development plans
shall consist of the following: (1) grading, (2)
architectural elevations, (3) landscaping, and (4)
other plans as required by the Director of
Community Planning and Development.
3. Geotechnical Study - Proof of geological and soils
stability of all proposed grading and development
within the subject parcels shall be submitted to
the satisfaction of the City prior to any
tentative tract map approval.
4. Landscape and Wall Plans - Landscape, street tree,
and fence/wall plans shall be prepared and
implemented for the entire project. Preliminary
landscape plans including: street tree, slope
planting, tree planting on individual lots,
fence/wall plans, and fire retardant planting
shall be approved by the Planning Commission.
Following such plan approval, final working
drawings shall be approved by the Director of
Community Planning and Development.
5. Landscaping Installation - Landscaping shall be
installed as follows:
(a) Erosion control landscaping for all
manufactured slopes shall be installed
immediately after the certification of rough
grading by the City.
(b) All tree planting shown on the approved
landscape plan per Condition No. 4 above,
shall be installed immediately after
certification of rough grading by the City.
Said planting to be maintained by the
developer until such time as released to the
Homeowner's Association or individual
property owner.
6. Private Streets - All private streets shall be
designed and constructed in accordance with
Section 9-4.103 of the Municipal Code.
Emergency Access - Emergency access provisions
shall be provided in accordance with the
following:
(a) The lower turnaround be stubbed out and
barricaded for use either as a through street
or emergency access if and when "The Ranch"
property is developed.
(b) That the intersection of the private road
with Golden Ridge Lane also be stubbed out
for possible access into "The Ranch"
property.

(c) If and when secondary access is obtained
through to "The Ranch" property,
consideration be given to abandoning as an
emergency access use of the equestrian trail
between Lots 43 and 44 to Steeplechase Drive.
8. Development Matrix - A Development Matrix shall be
submitted concurrently with the tentative tract
map. Said matrix shall identify for each lot the
following: setbacks, height provisions,
architectural design concept, and
colors/materials.
9. Water - Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of Orange
County Water Works District No. 4. Such
distribution facilities and appurtenances shall be
approved by the County Fire Marshal.
10. Slopes - All manufactured slopes shall be designed
and constructed in accordance with Sections
9-3.505 and 9-4.112 of the Municipal Code. All
such slopes shall be 2:1 ratio or flatter.
11. Other Improvements - Driveways, pedestrian ways,

equestrian/hiking trails, utility
undergrounding, street lights, traffic signals,
drainage facilities, and sanitary sewers shall be
located and constructed in accordance with Article
9-4.1 (Design Standards and Requirements) of the
Municipal Code and adopted City policy.
12. Fees - All required fees shall be paid prior to
approval of a final map.
13. Fire Protection - All requirements of the Orange
County Fire Marshal regarding on-site fire
protection shall be incorporated into the
composite plans and CC&Rs.
