Resolution Number 82-5-4-2131 RESOLUTION NO. 82-5-4-2 GENERAL PLAN AMENDMENT 82-2 (HOUSING ELEMENT AMENDMENTS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, TAKING ACTION ON GENERAL PLAN AMENDMENT 82-2 (HOUSING ELEMENT AMENDMENTS) WHEREAS, the City Council initiated consideration of General Plan Amendment 82-1A on January 5, 1982, to include proposed amendments to the Housing Element; and, WHEREAS, on April 20, 1982, the City Council determined that the Housing Element text would be considered as General Plan Amendment 82-2; and, WHEREAS, the City's Environmental Review Board has determined that the revised General Plan Housing Element will not have a significant impact on the environment, has accordingly issued a negative declaration for the project, and has otherwise carried out all requirements of the California Environmental Quality Act; and, WHEREAS, the City's Planning Commission has forwarded the Housing Element Amendments to the City Council recommending approval; and, WHEREAS, the City Council finds that: 1. The amendments serve to reinforce the community's desire to facilitate the improvement and development of housing and to make adequate provision for the housing needs of all segments of the community. 2. The revised Housing Element is in conformance with Government Code Sections 65583(a)(b)(c) and 65584. 3. The revised Housing Element updates and provides an update and refinement of the policies of the Housing Element originally adopted in 1974. -1- 132 NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby approve General Plan Amendment 82-2, adopting the Housing Element Amendments and directs that said amendments be incorporated into the General Plan Housing Element text as — follows: 1. CONTINUED AFFORDABILITY On page 6.21 under the "Policies" section, following the first two policies: "HOUSING UNITS WITH A CITY -APPROVED AFFORDABLE PROGRAM SHALL BE REQUIRED TO IMPLEMENT CONTROLS TO INSURE CONTINUED AFFORDABILITY. "SAID CONTROLS ARE TO INCLUDE PROVISIONS FOR THE PARTICIPATING FAMILY TO RECEIVE A PRO -RATA SHARE OF THE SELLING PRICE." 2. AFFORDABLE HOUSING AND THE GROWTH MANAGEMENT SYSTEM On page 5.13 at the end of the "Policies" section, the following two policies would be added: "COMMENSURATE WITH THE REVIEW OF A CITY - APPROVED AFFORDABLE HOUSING PROJECT, THE ALLOCATION SCHEDULE COULD BE AMENDED TO ACCOMMODATE THE PROJECT AS DEEMED APPROPRIATE, BUT NOT TO EXCEED THE PREVIOUSLY APPROVED NUMERICAL LIMIT. "ADJUST THE PROJECT RATING SCALE BY PROVIDING ADDITIONAL BONUS POINTS FOR HOUSING DEVELOPMENTS WHICH PROVIDE AFFORDABLE HOUSING UNDER A CITY - APPROVED PROGRAM. A MINIMUM NUMBER OF TOTAL POINTS, INCLUDING BONUS POINTS, MUST BE ACHIEVED IN ORDER TO QUALIFY FOR AN AMENDMENT TO THE ALLOCATION SCHEDULE." 3. MISSION DISTRICT IMPROVEMENTS On page 2.1 following the fourth sentence of the fourth paragraph: "THE PLANNING AND IMPLEMENTATION OF SUCH IMPROVEMENTS SHALL BE SENSITIVE TO THE ENVIRONMENTAL, CULTURAL, AND HISTORIC ASPECTS OF THE DISTRICT." -2- On page 4.8, at the end of Exhibit 1, under "Description" of the public improvements in the Mission District: "ASSESS AND CORRECT PUBLIC IMPROVEMENT DEFICIENCIES IN THE MISSION DISTRICT WITH THE UTMOST SENSITIVITY TO ENVIRONMENTAL, HISTORICAL, AND CULTURAL FACTORS."
