Resolution Number 82-5-4-1RESOLUTION NO. 82-5-4-1 ARCHITECTURAL CONTROL 82-2 (BROWN OFFICE BUILDING) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING ARCHITECTURAL CONTROL 82-2 (BROWN OFFICE BUILDING) WHEREAS: 127 1. The applicant, MEB Investments, 31952 Del Obispo, #240, San Juan Capistrano, California, has submitted an application for approval of a proposed office building located along San Juan Creek Road near the I-5 Freeway. 2. The City's Environmental Review Board has determined that the proposed project will not have a significant effect on the environment, has accordingly issued a negative declaration for the project, and has otherwise carried out all requirements of the California Environmental Quality Act; and, 3. The City's Architectural Board of Review has reviewed the project and forwarded it to the Planning Commission recommending approval subject to certain conditions. 4. The Planning Commission, at their meeting of April 13, 1982, denied Architectural Control 82-2. 5. The applicant has appealed the decision of the Planning Commission's denial of Architectural Control 82-2. 6. The City Council has reviewed the appeal and the determination of the Planning Commission and hereby finds and determines as follows: a. Although the project would convert 0.5+ acres to an institutional office use, it would not significantly reduce the opportunities for developing recreational facilities in that sufficient land has been zoned and designated in the General Plan for recreational use. b. The PD (Planned Development) District and the restricted uses contained in SDP (Specific Development Plan) 81-2 are consistent with the goals, objectives and policies of GPA 80-3 as it relates to providing for institutional office uses. C. The project, as designed and conditioned, is consistent with the PD District and all applicable requirements of Title 9 (Land Use) of the Municipal Code. -1- r_ _ ♦ n d. The development plan is consistent with the Y1 N% design objectives of the City in that the site plan, building footprint, and building elevations have accommodated a very difficult site configuration while maintaining consistency with the adopted Architectural Guidelines. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby approve AC 82-2 subject to the following conditions: Expiration of Approval - Per Section 9-2.305 of the Municipal Code, this project development approval shall expire on May 4, 1983--i.e., one year from the City Council approval date. If no building permit has been issued for the project by that date, the development approval shall become null and void. 2.Building Plans - Final building plans (working drawings) shall be reviewed by the Architectural Board of Review (ABR) and shall be approved only if said Board determines that the working drawings are consistent with the concept plans approved with this resolution. 3. Landscape Plans - Final landscape and irrigation plans shall be reviewed by the Director of Community Planning and Development and shall be approved only if the Director determines that said plans are consistent with the concept plans approved with this resolution. 4. Sign Program - The project sign program shall be su 7ect to.ABR approval during review of final building plans (reference Condition No. 2). 5. Exterior Lighting - The precise plan for parking lot and other ground -mounted lighting fixtures shall be subject to ABR approval during review of final building plans (reference Condition No. 2). 6. Equestrian Crossing - Visual warning devices shall be placed at non -signalized equestrian crossings to indicate to approaching vehicles the presence of equestrian traffic. These devices shall be reviewed and approved by the City Engineer prior to issuance of a building permit. 7. Horse Gathering Area - The site plan shall show the improvements for the horse gathering area and must do so in accordance with Section 9-4.106 of the Municipal Code. These improvements shall be reviewed and approved by the Equestrian Commission prior to issuance of a building permit. -2- 8. Roof Material - The roof material shall be a two- 129 A I2 9 /� piece barrel tile. 1 9. Exterior Finish - The exterior shall be mission stucco and shall have a smooth trowel finish. 10. Water - Water transmission and distribution facilities shall be designed, constructed, and dedicated in accordance with Section 9-4.109 of the Municipal Code and the requirements of Orange County Water Works District No. 4. Such distribution facilities and appurtenances shall be approved by the County Fire Marshal. 11. Slopes - All manufactured slopes shall be designed and constructed in accordance with Section 9-3.505 and 9-4.112 of the Municipal Code. All such slopes shall be 2:1 ratio or flatter. 12. Other Improvements - Driveways, pedestrian ways, bikeways, equestrian trails, utility undergrounding, street lights, traffic signals, drainage facilities, and sanitary sewers shall be located and constructed in accordance with Article 9-4.1 (Design Standards and Requirements) of the Municipal Code and adopted City policy. 13. Geotechnical Study - A geotechnical feasibility study shall be completed to determine the seismic safety and soils stability of all proposed grading and development within the project. The report shall be reviewed and approved by the City Engineer prior to issuance of a grading permit. 14. Fees - All required fees shall be paid prior to issuance of any building permit. 15. The developer shall be responsible for paying the proportionate share of the costs of the future traffic signal to be installed at the intersection of San Juan Creek Road and Camino Capistrano, as determined by the City Engineer.
