Resolution Number 82-3-16-3�3 RESOLUTION NO. 82-3-16-3 APPROVING CONDITIONAL USE PERMIT 82-1 (GLENDALE FEDERAL PARCEL A, TRACT 10318) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 82-1, PERMITTING AN OPEN SPACE SUBDIVISION IN TENTATIVE TRACT 10318 (GLENDALE FEDERAL PARCEL A) WHEREAS: 1. The applicant, Wilshire Diversified, Inc., 2710 Winona Avenue, Burbank, California, has submitted an application for a Conditional Use Permit to permit an open space subdivision in Tentative Tract 10318 (Parcel A) of the Glendale Federal Planned Community with lot sizes less than 10,000 square feet. 2. The City Environmental Review Board has determined that the proposed project will have a significant effect on the environment, has determined that the original environmental impact report and EIR supplement prepared for the overall planned community project effectively address the environmental impacts of this tentative map, which reports have been certified as final by the City Council, and has otherwise carried out all requirements of the California Environmental Quality Act; and, 3. A public hearing has been duly noticed and held to receive public testimony on the application. 4. The City Council does hereby find and determine as follows: a. The application is consistent with the goals, policies and objectives of the General Plan. b. The proposed open space subdivision is in conformance with the provisions of Title 9 (Land Use) of the Municipal Code and with the Glendale Federal PC ordinance (CDP 81-2). C. The proposed open space subdivision is compatible with existing and proposed uses within the immediate vicinity. -1- d. Over one-half of the area savings resulting from allowing Parcel A single-family lots to be less than 10,000 square feet has been incorporated into a private neighborhood park adjacent to the residential area pursuant to PC ordinance and LUC requirements. NOW, THEREFORE, BE IT RESOLVED, that based upon the preceding findings, the City Council does hereby approve Conditional Use Permit 82-1, subject to the following condition: March ATTEST: 1. Final landscape and grading plans for the private park shall be consistent with preliminary plans reviewed by the City Council. The final plans shall be reviewed and approved by the Director of Community Planning and Development prior to release for grading permit plan check to insure such consistency.
