APPROVING TENTATIVE TRACT 10318
(GLENDALE FEDERAL PLANNED COMMUNITY, PARCEL A)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING
TENTATIVE TRACT MAP 10318, PARCEL A AREA PLAN,
AND COMPOSITE DEVELOPMENT PLANS (GLENDALE
FEDERAL PLANNED COMMUNITY)
WHEREAS, the applicant, Wilshire Diversified, Inc.,
2710 Winona Avenue, Burbank, California, has submitted Tentative
Tract Map 10318 and accompanying Parcel A Area Plan and Composite
Development Plans, proposing to subdivide approximately 14.7
acres of land located in the Glendale Federal Planned Community
into 27 residential lots and two lettered lots; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will have a significant
effect on the environment, has determined that the original
environmental impact report and EIR supplement prepared for the
overall planned community project effectively address the
environmental impacts of this tentative map, which reports have
been certified as final by the City Council, and has otherwise
carried out all requirements of the California Environmental
Quality Act; and,
WHEREAS, the City Planning Commission has forwarded
the tentative map and accompanying Composite Development Plans
to the City Council recommending approval; and,
WHEREAS, a public hearing has been duly advertised
and held to receive public testimony on the application; and,
follows:
WHEREAS, the City Council finds and determines as
1. The proposed project, as conditioned, and its
design and improvements are consistent with the
1.3 (Medium Low Density Residential) designation
on the General Plan Map and is otherwise
consistent with all other elements of the General
Plan.
2. The proposed project, as conditioned, conforms
to all applicable requirements of Title 9 of the
City's Municipal Code (Land Use) and is
consistent with the Comprehensive Development
Plan (CDP 81-2) approved by the City Council for
the entire Glendale Federal Planned Community on
November 3, 1981.
3. The project site is physically suitable for the
type and density of the proposed project.

4. The design and improvements of the proposed
project will not cause substantial environmental
damage; nor will said design or improvements
avoidably injure wildlife or their habitat.
5. The design or improvements of the proposed
project will not cause serious public health
problems. -
6. The design or improvements of the proposed
project will not conflict with easements acquired
by the public at large for access through or use
of property within the proposed project.
7. The design or improvements of the proposed
project will not interfere with the maintenance
or preservation of an historical site.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby approve Tentative
Tract 10318, the Parcel A Area Plan, and accompanying grading,
landscape, and architectural concepts, subject to the following
conditions:
1. Home Warranty: The provisions of Chapter 8-6 of
the Municipal Code (Home Warranty Ordinance)
shall apply to any person, firm or corporation
selling or offering for sale within the project
three or more dwelling units -- not previously
occupied for residential purposes -- during any
twelve-month period.
2. CC&Rs: A set of Conditions, Covenants and
Restrictions (CC&Rs) shall be prepared and
implemented for the project. The CC&Rs shall
include at a minimum:
(a) Provisions on the use and maintenance, by
the homeowners' association, of recreation
areas, other common areas, and slopes.
(b) The prohibition of radio or television
antennas projecting above any roof eaves
(pursuant to Section 9-3.609 of the Municipal
Code).
The CC&Rs shall be approved by the City Attorney
prior to approval of a final map.
3. Grading Plan: A preliminary grading plan for
the project shall be approved by the Director of
Community Planning and Development prior to City
Council approval of a final map and after the
Director's determination that said grading plan
is consistent with the grading concepts approved
with this tentative map.

4. Architecture: Final building plans shall be
approved by the Director of Community Planning
and Development prior to building plan check and
after the Director's determination that said
plans are consistent with the schematic
elevations approved with this tentative map.
5. Corrales Boundary Wall - Design and materials
for the wall separating this tract fromiTract
7654 (Corrales Estates) shall be subject to
administrative approval by the Director of
Community Planning and Development.
6. Landscape and Wall Plans: Landscape, street
tree, and fence/wall plans shall be prepared and
implemented for the entire project. Final
landscaping, street tree, and fence/wall plans
shall be approved by the Director of Community
Planning and Development prior to issuance of
any building permits for the project and after
the Director's determination that said plans are
consistent with the concepts approved with this
tentative map.
7. Landscaping Installation: Landscaping shall be
installed as follows:
(a) Erosion control landscaping for all
manufactured slopes shall be installed
immediately after the certification of
rough grading by the City.
(b) Street trees and all other non -erosion -
control landscaping shall be installed
after completion of grading. No final
building inspection shall be conducted for
any dwelling unit within a given phase
until all landscaping has been installed
for that phase and approved by the Director
of Community Planning and Development.
8. Landscape Maintenance and Maintenance Easements:
The developer shall be responsible for adequately
installing and maintaining all landscaping until
such maintenance may be assumed by the homeowners'
association. An open space maintenance easement
shall be created over all major slopes that are
within residential lots. Landscaping on said
slopes shall be maintained by the homeowners'
association.

9. Model Complex: Final plans for any sales/model
complex shall be approved by the Director of
Community Planning and Development prior to
issuance of any building permit for said complex.
The Director may require provision for removal
and restoration of any temporary parking, sales,
or model facility as a condition of such approval.
10. Park Dedication: Per the Land Use Code and the
PC ordinance regulating this project, one-half
credit shall be given for the private park site
(included within the tract) toward satisfaction
of the City's parkland dedication requirement --
LUC Article 9-4.3. Thus, from computations in
accordance with said Article, the dedication
requirement for this tract is .72 acres x 1/2 =
.36 acres. This requirement shall be met by the
payment of park fees in lieu of land dedication
(in accordance with the effective City fee
schedule at the time of payment) or, upon
agreement between the City Council and the
property owner, by the dedication of land within
or near the subject planned community. Said fee
payment or dedication agreement shall be
completed prior to approval of a final map.
11. Recreation Vehicle Storage Area: Final plans
for the RV storage area shall be approved by the
Director of Community Planning and Development
prior to release of any grading plan for said
area for plan check. Access to the RV area
shall be via an access drive, constructed to
minimum standards, intersecting La Novia Avenue.
The location of said intersection shall in no
way predetermine the location of the future
collector street serving Parcel C.
12. Vehicular Access Rights: Vehicular access
rights to all primary, secondary, and commuter
highways shall be released and relinquished to
the City except at street intersections.
13. Public Streets: All the public and private
streets shall be designed and constructed in
accordance with Section 9-4.103 of the Municipal
Code. In addition, public streets shall be
dedicated in accordance with said Section.
La Novia Avenue shall be constructed as a full
street section up to a point opposite the
recreation vehicle access road. Beyond that
point, a half street section shall be constructed.

14. Water: Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of
Orange County Waterworks District No. 4. Such
distribution facilities and appurtenances shall
be approved by the County Fire Marshal.
15. On -Site Fire Protection: On-site fire protection
shall be provided for the dwelling unit on Lot
15 to the satisfaction of the County Fire Marshal.
16. Slopes: All manufactured slopes shall be designed
and constructed in accordance with Section
9-3.505 and 9-4.112 of the Municipal Code. All
such slopes shall be 2:1 ratio or flatter,
excepting the slope located above the emergency
access road along the east boundary of the tract
which may be steeper than 2:1.
17. Other Improvements: Driveways, pedestrian ways,
bikeways, equestrian trails, utility
undergrounding, street lights, traffic signals,
drainage facilities, and sanitary sewers shall
be located and constructed in accordance with
Article 9-4.1 (Design Standards and Requirements)
of the Municipal Code and adopted City policy.
18. Geotechnical Study: A geotechnical feasibility
study shall be completed to determine the seismic
safety and soils stability of all proposed
grading and development within the project. The
report shall be reviewed and approved by the
City Engineer prior to approval of a final map.
19. Fees: All required fees shall be paid prior to
approval of a final map.
20. Traffic Signal: The developer shall enter into
an agreement and provide the necessary surety to
pay 50 percent of a proposed traffic signal to
be located at San Juan Creek Road and La Novia
Avenue.
21. 69 KV Transmission Line: The developer shall
underground the existing overhead 69 KV
transmission line within areas of development.
22. Ground Water Removal System: The developer
shall install a ground water removal system
(e.g., French drains) in accordance with Article
9-4.1 (Design Standards and Requirements) of the
Municipal Code and adopted City policy. Design
of this system shall be subject to the
administrative approval of the Director of
Public Works.

0 23. Equestrian Linkage - Provision shall be made for
an equestrian trail adjacent to La Novia Avenue
from the recreation vehicle access road to the
northerly limits of the project unless an
alternate linkage is approved by the City prior
to approval of a final map. Final design and
alignment of the trail shall be approved by the
Planning Commission.
24. School Impacts - Prior to approval of a final
map, the applicant shall enter into an agreement
with the City to provide a mechanism for the
mitigation of adverse impacts to local schools
from the project.
