A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO,

WHEREAS, annexation of
which lies in the unincorporated
east City limits, is tentatively
February 16, 1982; and,

the 261 -acre Lacouague Ranch
County territory abutting the
scheduled to be completed on
WHEREAS, the subject property, described more fully
in Attachment "A," is currently under an Agriculture Preservation
Contract executed by the property owner and the County of Orange
by Resolution 69-185, pursuant to the provisions of the California
Land Conservation Act of 1965 (Williamson Act) as amended; and,
WHEREAS, upon the completion of the annexation, the City
of San Juan Capistrano will succeed to all of the rights, duties,
and obligations of the County, including the administration of
the Williamson Act Contract upon the property; and,
WHEREAS, the owners of said property, Jean P. Lacouague,
Grace L. Manivil, and Julia J. Pon, hereinafter referred to as
"Owners," have submitted a petition for cancellation of the
Williamson Act Contract pursuant to the provisions of Section
51282.1 of the California Government Code; and,
WHEREAS, the Environmental Review Board has reviewed
the matter and determined that it would not have a significant
impact on the environment and has issued a Negative Declaration,
and has otherwise carried out the applicable provisions of the
California Environmental Quality Act of 1970; and,
WHEREAS, a public hearing relating to the cancellation
of the aforementioned Agriculture Preservation Contract was
duly advertised and held on February 2, 1982; and,
WHEREAS, upon consideration of the testimony of all
witnesses and other evidence, the City Council has found and
determined that said cancellation is consistent with the
applicable provisions of the Williamson Act and that:
1. The cancellation and alternate use will not
result in discontigous patterns of urban
development because the subject property is
directly contiguous to a developed residential
area of the City on the west; and to a residential
and equestrian development on the north; and,

22. The proposed development concept for the property
is consistent with applicable provisions of the
City General Plan which was in effect on October 1,
1981, because it proposes a low density
residential development with open space, which
respects land use designations and other
constraints shown on said General Plan for the
subject property.
NOW, THEREFORE, BE IT RESOLVED that the application of
Owners for the cancellation of their Williamson Act Contract
be and is hereby tentatively approved, and the City Clerk is
authorized and directed to record a copy of this Resolution
with the County Recorder of the County of Orange forthwith. A
final certificate of cancellation will be recorded upon Owner's
compliance with the following terms, conditions and contingencies:
a. The subject property is annexed to the City of
San Juan Capistrano.
b. Payment in full of the amount of fee computed in
accordance with the provisions of Sections 51283
and 51283.1 of the Government Code.
BE IT FURTHER RESOLVED that this Resolution also be
filed with the Secretary of the Department of Agriculture, the
Local Agency Formation Commission, and the Owners of said property.
