Resolution Number 84-6-5-4RESOLUTION NO. 84-6-5-4 ANIMAL FACILITY RULES AND FEE SCHEDULE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING RULES AND REGULATIONS FOR ANIMAL FACILITIES, ADOPTING A FEE SCHEDULE, AND REPEALING RESOLUTION NO. 81-11-3-5 41 A01 H:b WHEREAS, on October 10, 1976, the City Council adopted Resolution No. 76-10-6-1, adopting rules, regulations and a fee schedule for animal facilities within the City; and, WHEREAS, the provisions of the aforesaid resolution are administered and enforced by the County of Orange. SECTION 1. Amendment. 1. The following definitions are hereby added to Resolution No. 76-10-6-1; "SECTION 1. Definitions. "F. A large animal is any animal weighing 300 pounds or more. "G. A medium animal is any animal weighing greater than 50 pounds, but less than 300 pounds. "H. A dog or cat is any animal defined as such in Ordinance No. 2836 of the County of Orange. "I. An animal is as defined in Ordinance No. 2836 of the County of Orange. "J. A contract cit is any municipality that has entered into a contract wit the County of Orange for enforcement of Animal Control and Animal Shelter Services, or for either of such services. "K. Actual Cost is the actual expense incurred by the County of Orange, including, but not limited to, salaries, employee benefits, overhead supplies, animal food, medication, contract services. "L. A kennel means any property where four (4) or more dogs, or four (4) or more cats, over the age of four (4) months, are kept or maintained for any purpose except veterinary clinics and hospitals, and except property for which an animal permit has been issued pursuant to Section 4-1-76 of the Codified Ordinances of the County of Orange. "M. A pet shop means any person or facility engaged in the sale or trade of live animals on a commercial basis. -1- 3 N. A grooming parlor means any premises where animals are groomed, brushed, Zipped or bathed on a commercial basis. "O. An animal rental establishment means a place or facility where animals other than dogs, cats, or equines are kept or maintained for hire. "p. A permanent animal exhibition means any property where animals are exposed for public viewing for entertainment, instruction or advertisement, including animal acts, on a regular basis, excluding activities conducted primarily for the instruction or entertainment of persons for which no charge, fee, or donation is collected or solicited. "Q. A commercial stable means any property where equines are sheltered or fed on a commercial basis. "R. A circus means a carnival, tent show or show in the open air, or in a hall or building not specifically constructed for theatrical purposes, wherein animals are exposed for public viewing for entertainment, instruction or advertisement. "S. A rodeo means any activity or show in which equines or bovines are exposed for public viewing for entertainment, instruction or advertisement, excluding a permanent animal exhibition, excluding activities conducted primarily for the instruction or entertainment of persons for which no charge, fee, or donation is collected or solicited. "T. Im ounded means having been received into the custody of the Health Officer of Orange County or his deputy. "U. A tem orary animal exhibition means any activity, or property used or, the public viewing of animals for entertainment, instruction or advertisement, including animal acts, of less than a regular basis, excluding activities conducted primarily for the instruction or entertainment of persons for which no charge, fee or donation is collected or solicited." The Fee Schedule contained in Resolution No. 76-10-6-1 is hereby amended to read as follows: "SECTION 11. Fee Schedule. "The following fee schedule has been adopted for services rendered by the Veterinary Public Health Division of the Orange County Health Department: -2- "A. Medical or surgical care, per treatment, performed by private veterinarian, flat rate . . . . . . . . . . . . . $30.00 "Note: The Director may charge the owner or custodian for veterinary care rendered to impounded animals and such charges shall constitute a lien on said animals. He may approve payment from County funds to practicing veterinarians rendering treatment to impounded animals. i "B. Individual Animal Licenses: I "Note 1. A dog license can be sold only for the period covered by a valid rabies vaccination certificate acceptable to the California Department of Health (CA. Admin. Code. 2606.4). I "Note 2. The reduced fee for a neutered animal will be allowed only upon presentation of a certificate of spaying, castration, or of the dog's inability to reproduce signed by a licensed veterinarian. "Note 3. Any person who fails to purchase or renew a license within fifteen (15) days after it has become due or expired shall be deemed delinquent and may be required to pay a late fee of five dollars ($5.00) in addition to the prescribed fee. I "Note 4. Once purchased, there will be no refund of license fees unless it is demonstrated that, at the time the license became effective, the animal was not subject to i licensing. Animal Facility License: "Note: A non-refundable application fee of $35.00 shall be charged for processing an application for any of the following facility licenses. Penalty Fee . . . . . . . . . . . . 258 of Licensing Fee "Any owner, operator, or person who fails to purchase or renew an Animal Facility License within thirty (30) days after it has become due or expired shall be deemed delinquent and may be required to pay a late fee of 258 of the license in addition to the prescribed fee. Except as specifically amended herein the remaining terms and conditions of Resolution No. 76-10-6-1 shall remain in full force and effect. SECTION 3. Effective Date. This Resolution shall become effective on July 1, 1984, at which time Resolution No. 81-11-3-5 shall be repealed.
