ARCHITECTURAL CONTROL 84-2 (BRINDERSON/WILLIAM
LYON COMPANY)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING ARCHITECTURAL CONTROL 84-2
(BRINDERSON/WILLIAM LYON COMPANY)
WHEREAS, the applicant, William Lyon Company, P. 0. Box
7520, Newport Beach, California 92660, has submitted an
application for approval of a 274 -unit apartment complex; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will have a significant
effect on the environment, has required the preparation of a
Focus Environmental Impact Report, which report has been certified
as complete by the City Council, and has otherwise carried out
all requirements of the California Environmental Quality Act;
and,
WHEREAS, the City's Architectural Board of Review has
reviewed the project and forwarded it to the Planning Commission
recommending approval subject to certain conditions; and,
WHEREAS, the City Council hereby finds and determines
as follows:
a. The project is consistent with all applicable
goals, objectives, and policies of the General
Plan as amended by General Plan Amendment 84-1,
Item B.
b. The project, as designed and conditioned, is
consistent with all applicable requirements of
Title 9 (Land Use) of the Municipal Code as per
the conditions of approval made a part of this
application and Rezone 84-1.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
does hereby approve Architectural Control 84-2, subject to the
following conditions:
Expiration of Approval - Per Section 9-2.305 of
the Municipal Code, this project development
approval shall expire concurrently with the
expiration of Growth Management Residential
Concept Plan 84-1. If no building permit has been
issued for the project by that date, the
development approval shall become null and void.

din Plans - Final building plans (working

shall be reviewed by the Architectural
Board of Review (ABR) and shall be approved only
if said Board determines that the working drawings
are consistent with the concept plans approved
with this resolution with the exception of the
following:
a. The tall archway shown at the entrance of the
8-plex and 14-plex shall be revised to
reflect a more simple design.
b. The tile capping on the stairway for the
8-plex shall be eliminated in favor of wood.
C. The "cutout" on the recreation building shall
be revised to a trellis at the entrance of
the building, and the chimney shall be
revised such that it is more effectively
integrated into the building and is of a more
appropriate scale.
3. Landscape Plans - Final landscape and irrigation
plans shall be reviewed by the ABR during Phase
III review and shall be approved only if the ABR
determines that said plans are consistent with the
concept plans approved with this resolution.
4. Exterior Lighting - The precise plan for parking
lot and other ground -mounted lighting fixtures
shall be subject to ABR approval during review of
final building plans. Said plan shall include
non -glare security lighting in parking areas.
5. Materials and Colors - Materials and colors of the
stucco, wood trim and tile roof to be approved
during Phase III review by the Architectural Board
of Review.
6. Roof Material - The roof material shall be an "S"
tile and shall have a matte finish.
7. Stucco Finish - The stucco finish shall be a
smooth "mission" style finish.
8. Skylights - Bronze colored skylights shall be
utilized in order to reduce glare.
9. Noise
a. Noise attenuation measures shall be
incorporated at the buildings by means of
double glazing of windows, extra thickness in
windows (3/16") and walls, and transparent
noise walls for outdoor patio areas.

b. A comprehensive noise study shall be
conducted prior to the issuance of building
permits to determine the effectiveness of the
noise attenuation provisions. In the event
that modifications are required to meet the
City's noise standards, it shall be the
buildings that are modified to meet the
standards. Any revised noise attenuation
plans shall be reviewed and approved by the
Planning Commission.
C. Additional soundproofing shall be
incorporated into the carriage units to
ensure that noise from garages is adequately
mitigated.
10. Garage Door Openers - Electric garage door openers
shall be provided for all units.
11. Sign Program - A comprehensive on-site project
identification, direction, information and guest
parking sign program shall be prepared and
reviewed and approved by the Architectural Board
of Review during Phase III review.
12. Parking Management Program - A parking management
program shall be developed by the applicant
depicting the location of assigned covered and
uncovered parking spaces to the respective units
and detailed management policies restricting
tenants from using turf -block. Said plan shall be
reviewed and approved by the Planning Commission.
13. Recreational Vehicles - Recreational vehicles
including, but not limited to, any camper unit,
house car or motor home, bus, trailer, trailer
coach, camp trailer, boat, aircraft, mobile nome,
inoperable vehicle, or any other similar vehicle
shall be prohibited on-site. A deed restriction
shall be placed on the property for insurance.
14. Recreational Facility - The recreation facilities
shall be used solely by residents, their family
members and house guests and shall not be used or
rented for outside interests.
15. Secondary Access - The secondary access drive that
provides ingress/egress from Via California
(extended) shall be designed for emergency access
purposes only. Said drive shall be cul-de-saced
with grass-crete.

16. Landscape Concept Plan - The following provisions
shall be incorporated into the final landscape
plans:
a. Tall -growing trees and shrubs such as
eucalyptus (in excess of 30 feet) shall be
prohibited in the planting adjacent to the _
freeway. The plant palette for the remainder
of the site may include taller trees, but
they shall be used judiciously so as not to
create a wall of trees which obstructs views.
b. Walls, trees, or any other obstructions that
could restrict sight distance along Via
California shall be restricted.
C. Said plan shall be reviewed by a City
approved arborculturalist with a report to
Planning Commission prior to Phase III
review.
17. Traffic Signals - A traffic signal shall be
installed at Camino Las Ramblas for the
intersection created by the project entry and the
northbound off -ramp for Interstate 5. Conduit
shall be installed for the future interconnect
from this new intersection to Via California. In
addition, the applicant shall enter into an
agreement to participate in the future
installation of a traffic signal at Camino Las
Ramblas and Via California.
18. Public Streets - Via California shall be designed,
dedicated and constructed in accordance with
Section 9-4.103 of the Municipal Code. Said
improvements shall be from Camino Las Ramblas
north to the emergency access.
19. Private Streets - The private streets shall be
designed and constructed in accordance with Section
9-4.103 of the Municipal Code.
20. Water - Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of
Capistrano Valley Water District. Such
distribution facilities and appurtenances shall be
approved by the County Fire Marshal.
21. Sanitary Sewers - Sanitary sewers shall be located
and constructed in accordance with Article 9-4.1
(Design Standards and Requirements) of the
Municipal Code and adopted City policy.

22. Other Improvements - Driveways, utility
undergrounding, street lights, and drainage
facilities shall be located and constructed in
accordance with Article 9-4.1 (Design Standards
and Requirements) of the Municipal Code and
adopted City policy.
23. Fees - All required fees shall be paid prior to
approval of the public improvement plans.
24. Camino Las Ramblas - Striping and channelization
plans for Camino Las Ramblas shall be submitted
for approval to the City Engineer.
