RESOLUTION OF APPLICATION - WISH-CAMERO
ANNEXATION
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, APPLYING
FOR THE ANNEXATION OF THE WISH AND CAMERO
PROPERTIES TO THE CITY AND ACCEPTING PROPERTY
TAX TRANSFER FOR THOSE PROPERTIES
WHEREAS, Mr. Robert L. Wish and Mr. Raymond Camero have
requested annexation of their parcels, located at the north
terminus of Peppertree Bend in unincorporated territory
(Assessor's Parcels Nos. 121-090-09, 121-090-12 and 121-090-20,
respectively), to the City of San Juan Capistrano per their
letters dated May 14, 1984, and June 20, 1984; and,
WHEREAS, the subject parcels lie within the City's
adopted sphere of influence; and,
WHEREAS, the City is the most logical and
best -situated jurisdiction to provide sewer and other public
services to the parcels; and,
WHEREAS, the parcels obtain access through the City of
San Juan Capistrano; and,
WHEREAS, the City's Environmental Review Board has
determined that the subject annexation will not have a
significant impact on the environment, has accordingly issued a
Negative Declaration for the annexation project, and has otherwise
carried out all requirements of the California Environmental
Quality Act; and,
WHEREAS, the City and County have entered into a Master
Property Tax Transfer Agreement providing for the exchange of
property tax revenues from annexed properties.
NOW, THEREFORE, BE IT RESOLVED, that the City of San
Juan Capistrano; California, does hereby make application to the
Local Agency Formation Commission to annex the property herein
described to the City and requests that appropriate proceedings
be taken pursuant to the Municipal Organization Act of 1977. The
City does, accordingly, represent that:

3. Maps showing the boundaries of the affected
territory are attached hereto as Exhibits "A" and
"B;" and,
4. The reasons for the proposed change of
organization are as follows:
a. The affected territory is within the City's
sphere of influence;
b. The City is capable of efficiently providing
all municipal services to the parcels;
C. The only permanent nonemergency access to the
parcels is through the City;
d. The parcels are already located within the
City's Capistrano Valley Water District;
e. The most feasible source of sewer service to
the parcels is from the City; and,
f. The property owners have requested annexation
to the City.
BE IT FURTHER RESOLVED, that the City does hereby agree
to accept the exchange of property tax revenues for the subject
Wish-Camero annexation in accordance with the terms of the Master
Property Tax Agreement entered into between the City of San Juan
Capistrano and the County of Orange on October 28, 1980, and that
the City concludes that said property is developed territory for
the purposes of said agreement.
