AMENDMENT TO LAND USE CODE DEFINITIONS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING
THE DEFINITIONS RELATED TO NON-RESIDENTIAL
BUILDING HEIGHT, FINISH GRADE, ATTIC,
BASEMENT AND STORY
WHEREAS, on May 4, 1977, the City Council adopted,
pursuant to Section 9-1.106 of the Municipal Code, a set of
definitions for terms used in the City Land Use Code; and,
WHEREAS, the following definitions are needed to
clarify the Land Use Code regulations concerning building height.
NOW, THEREFORE, BE IT RESOLVED that Appendix A
(Definitions) to the Land Use Code is hereby amended by the
addition of the following definitions:
"Non -Residential Building or Structure Height - The
vertical distance from finish grade to the topmost
point of the roof of a non-residential building or to
the highest point of a structure other than a building.
Chimneys and finials are not included in determining
building height.
"Finish Grade - The finished surface of ground abutting
a bui—`lding or other structure.
"Attic - The uninhabitable space between the upper
surface of the top floor and the roof above. An attic
is not considered a story.
"Basement - An area partially above ground and having no
more than 50 percent of its height, at any point, above
finish grade on each and every side. A basement is not
considered a story.
"Story - That portion of a building included between the
upper surface of any floor and the upper surface of the
floor above, except that the topmost story shall be
that portion of a building included between the upper
surface of the top floor and the ceiling or roof above.
If the space between the upper surface of the top floor
and the roof above is designed for habitation, then it

is considered a story. In addition, if the bottom
level of a structure has more than 50 percent of its
height above finish grade on any side, then it is
considered a story."
