TENTATIVE PARCEL MAP 83-861 (ENDEVCO/AMINTA)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING
TENTATIVE PARCEL MAP 83-861 (ENDEVCO/AMINTA)
WHEREAS, the applicant, AMINTA, c/o Cox, Castle and
Nicholson, 2049 Century Park East, 28th Floor, Los Angeles,
California, has submitted Tentative Parcel Map 83-861, proposing
to subdivide approximately 33.32 acres of land into two lots,
located on Assessor's Parcel No. 650-111-01; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will not have a significant
effect on the environment, has accordingly issued a Negative
Declaration for the project, and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the City Planning Commission has forwarded the
parcel map to the City Council recommending approval; and,
WHEREAS, a public hearing has been duly advertised and
held to review and receive public testimony on the application;
and,
WHEREAS, the City Council of the City of San Juan
Capistrano finds and determines as follows:
1. The proposed project, as conditioned, and its
design and improvements are consistent with the
4.0 (Industrial Park) designation on the General
Plan Map and are otherwise consistent with all
other Elements of the General Plan.
2. The proposed project, as conditioned, conforms to
all applicable requirements of Title 9 of the
City's Municipal Code (Land Use).
3. The project site is physically suitable for the
type and density of the proposed development.
4. The design and improvements of the proposed
project will not cause substantial environmental
damage; nor will said design or improvements
avoidably injure wildlife or their habitat.
5. The design or improvements of the proposed project
will not cause serious public health problems.
6. The design or improvements of the proposed project
will not conflict with easements acquired by the
public at large for access through or use of
property within the proposed project.

The design or improvements of the proposed project
will not interfere with the maintenance or
preservation of an historical site.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby approve Tentative
Parcel Map 83-861, subject to the following conditions:
Landscaping Installation: Landscaping shall be
installed as follows:
(a) Erosion control landscaping for all
manufactured slopes shall be installed
immediately after the certification of rough
grading by the City.
(b) Street trees and all other non -erosion -
control landscaping shall be installed in
accordance with a landscape plan approved by
the Director of Community Planning and
Development.
2. Vehicular Access Rights: Vehicular access rights
to Rancho Viejo Road shall be released and
relinquished to the City except at street
intersections.
3. Public Streets: The applicant shall dedicate
Rancho Viejo Road along the project's frontage in
accordance with the Master Plan of Arterial
Highways and Section 9-4.103 of the Municipal
Code. Specifically, the median shall be removed
and secondary highway standards shall be used.
4. Construction Agreement: Prior to approval of the
Final Parcel Map, the applicant shall enter into
an agreement to participate in the design and
construction of Rancho Viejo Road and related
improvements, including driveways, pedestrian
ways, bikeways, equestrian trails, utility
undergrounding, street lights, traffic signals,
drainage facilities, and sanitary sewers. Said
improvements shall be located, designed, and
constructed, in accordance with Article 9-4.1
(Design Standards and Requirements) of the
Municipal Code and adopted City policy, within two
years from the date of approval of the final
parcel map or prior to the applicant being given
building permits for structures within the
tentative map boundaries.

5. Bikeway: The applicant shall design and improve a
minimum 8 -foot bikeway along the project's street
frontage. Said design shall preserve the existing
trees and minimize retaining walls by varying the
bikeway's width and meandering the bikeway around
the trees. Said improvement shall be designed and
constructed within two years from the date of
approval of the final parcel map or prior to the
applicant being given building permits for
structures within the tentative map boundaries.
6. Water: Upon design and construction of the
aforementioned improvements (reference Condition
No. 4), water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of
Capistrano Valley Water District. Such
distribution facilities and appurtenances shall be
approved by the County Fire Marshal.
7. Slopes: Upon design and construction of the
aforementioned improvements (reference Condition
No. 4), all manufactured slopes shall be designed
and constructed in accordance with Section 9-3.505
and 9-4.112 of the Municipal Code. All such
slopes shall be 2:1 ratio or flatter.
8. Geotechnical Study: Upon design and construction
of the aforementioned improvements (reference
Condition No. 4), a geotechnical feasibility study
shall be completed to determine the seismic safety
and soils stability of all proposed grading and
development within the project. The report shall
be reviewed and approved by the City Engineer
prior to approval of a final map.
9. Traffic Signal: Prior to approval of the Final
Parcel Map, the applicant shall enter into an
agreement to participate in the funding and
construction of a traffic signal at Junipero Serra
Road and Rancho Viejo Road.
10. Maintenance of Landscape and Open Space Easement:
The applicant shall enter into an agreement with
the City to maintain the landscape areas within
the public right-of-way for Rancho Viejo Road and
to maintain the ravine area within the open space
easement in a natural state.
11. Lot Line Adjustment: The applicant shall make a
good faith effort to process a lot line adjustment
with the parcel to the south for shared access.
12. Access: Access to the property shall be from the
existing Endevco driveway with the potential for a
second shared access with the adjoining parcel to
the south (reference Condition No. 8).

13. Fees: All required fees shall be paid prior to
approval of a final map.
