APPROVING ARCHITECTURAL CONTROL 83-4
(LAS HADAS)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING ARCHITECTURAL CONTROL 83-4 (LAS HADAS)
WHEREAS, the applicant, Gerald J. Chazan, 431 North
Brand Boulevard, Glendale, California, has submitted an
application for approval of an office building complex located on
Del Obispo Street between Los Rios Street and the Trabuco Creek
Flood Channel; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will not have a significant
effect on the environment, has recommended certification of a
Negative Declaration by the City Council, and has otherwise
carried out all requirements of the California Environmental
Quality Act; and,
WHEREAS, the City's Architectural Board of Review has
reviewed the project and forwarded it to the Planning Commission
recommending approval subject to certain conditions; and,
WHEREAS, the City Council hereby finds and determines
as follows:
1. The project is consistent with all applicable
goals, objectives, and policies of the General
Plan.
2. The project, as designed and conditioned, is
consistent with all applicable requirements of
Title 9 (Land Use) of the Municipal Code and the
Los Rios Precise Plan as amended.
NOW, THEREFORE, BE IT RESOLVED that the City Council
does hereby approve Architectural Control 83-4, subject to the
following conditions:
1. Expiration of Approval - Per Section 9-2.305 of
the Municipal Code, this project development
approval shall expire on November 15, 1984--i.e.,
one year from the City Council approval date. If
no building permit has been issued for the project
by that date, the development approval shall
become null and void.
2. Building Plans - Final building plans (working
drawings) shall be reviewed by the Architectural
Board of Review (ABR) and shall be approved only
if said Board determines that the working drawings
are consistent with the concept plans approved
with this Resolution.

j3. Landscape Plans - Final landscape and irrigation
plans shall be reviewed and approved by the
Planning Commission prior to Phase III review.
4. Sign Program - The project sign program shall be
subject to ABR approval during review of final
building plans (reference Condition No. 2).
5. Exterior Lighting - The precise plan for parking
lot and other ground -mounted lighting fixtures
shall be subject to ABR approval during review of
final building plans (reference Condition No. 2).
6. Stucco Finish - The stucco finish shall be a
smooth trowel "mission" finish.
7. Window/Door Detail - The window and door details
shall be revised to incorporate an exposed sill
with a stucco wrap at the top and sides.
8. Grading Plan - The grading plan for the project
shall be revised showing Buildings A and B lowered
to elevation 91.5 and the elevations of the
parking lot and landscape areas lowered to the
maximum permissible to provide for adequate
drainage and provide for the connection to Paseo
Adelanto.
9. Retail Space - Retail space shall be limited to
2,000 square feet unless additional parking can be
provided.
10. Building Setback from Los Rios Street - The
setback for Building A shall be increased from 6
feet to 8 feet.
11. Paseo Adelanto Improvements - Paseo Adelanto shall
be extended north of Del Obispo Street a
sufficient distance in order to provide access to
the project. Said improvements shall include any
necessary traffic signal modifications at Del
Obispo/Paseo Adelanto. A participation agreement
shall be executed between the applicant and the
City for implementation of said improvement prior
to the issuance of building permits.
12. Vehicular Access Rights - Vehicular access rights
To Del Obispo Street and Los Rios Street shall be
released and relinquished to the City except at
street intersections.
13. Public Streets - Del Obispo Street, Paseo
Adelanto, and Los Rios Street shall be designed,
constructed, and dedicated in accordance with
Section 9-4.103 of the Municipal Code.

14. Water - Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of
Capistrano Valley Water District. Such
distribution facilities and appurtenances shall be
approved by the County Fire Marshal.
15. Slopes - All manufactured slopes shall be designed
and constructed in accordance with Sections
9-3.505 and 9-4.112 of the Municipal Code. All
such slopes shall be 2:1 ratio or flatter.
16. Other Improvements - Driveways, pedestrian ways,
bikeways, utility undergrounding, street lights,
drainage facilities, and sanitary sewers shall be
located and constructed in accordance with Article
9-4.1 (Design Standards and Requirements) of the
Municipal Code and adopted City policy.
17. Geotechnical Study - A geotechnical feasibility
study shall be completed to determine the seismic
safety and soils stability of all proposed grading
and development within the project. The report
shall be reviewed and approved by the Building
Official prior to approval of a final map.
18. Fees - All required fees shall be paid prior to
approval of a final map.
19. Striping Plan - A striping and signing plan for
Del Obispo Street shall be designed, approved, and
implemented in conjunction with the project
development.
PASSED, APPROVED AND ADOPTED this 15th day of
November 1983 , by the following vote, to wit:
AYES: Councilmen Hausdorfer, Buchheim,
Schwartze, and Mayor Bland
NOES: Councilman Friess
