AC 83-3 (SCHAUWECKER/BERG)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING AC 83-3
WHEREAS, the applicant, Senior Living, 1900 Powell
Street, Suite 460, Emeryville, California, submitted an
application for approval of a retirement hotel located on
Parcel 3 of Parcel Map 80-856; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will not have a significant
effect on the environment, has accordingly recommended issuance
of a Negative Declaration for the project, and has otherwise
carried out all requirements of the California Environmental
Quality Act; and,
WHEREAS, the City's Architectural Board of Review has
reviewed the project and forwarded it to the Planning Commission
recommending approval subject to certain conditions; and,
WHEREAS, the Planning Commission has failed to act on
the application as the result of a 2-2 tie vote; and,
WHEREAS, the City Council, after a duly advertised
public hearing does hereby find and determine as follows:
a. The project is consistent with all applicable
goals, objectives, and policies of the General
Plan.
b. The project, as designed and conditioned, is
consistent with all applicable requirements of
Title 9 (Land Use) of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby approve AC 83-3,
subject to the following conditions:
1. Expiration of Approval - Per Section 9-2.305 of
the Municipal Code, this project development
approval shall expire on October 6, 1984 -- i.e.,
one year from the City Council approval date. If
no building permit has been issued for the project
by that date, the development approval shall
become null and void.
2. Building Plans - Final building plans (working
drawings) shall be reviewed by the Architectural
Board of Review (ABR) and shall be approved only
if said Board determines that the working drawings
are consistent with the concept plans approved
with this resolution.

3. Landscape Plans - Final
landscape and irrigation
plans shall be reviewed
and approved by the City
Council.
4.
Sign Program - The project sign program shall be
subject to ABR approval during review of final
building plans (reference Condition No. 2).
5. Exterior Lighting - The precise plan for parking
lot and other ground -mounted lighting fixtures
shall be subject to ABR approval during review of
final building plans (reference Condition No. 2).
6. Finish Floor Elevation - Finish floor elevation
for the building shall be lowered to the defined
one -foot elevation above the projected 100 -year
floodline.
7. Landscape Concept Pn - The following
modifications shalla
l be incorporated into the final
landscape plans:
(a) Leyland Cypress shall replace the proposed
eucalyptus trees between the project
buildings and the Capistrano Racquet Club.
(b) The English Laurel (Prunus Laurocerasus)
shall be a tree variety rather than shrub.
(c) All screen and masonry walls shall have a
stucco finish.
(d) Provide for landscape planting and
maintenance for that portion of the property
located between San Juan Creek Road and the
project.
8. Roof Plan - The roof plan shall be modified to
include the following:
(a) Roof pitch should be lowered to 4:12.
(b) A pitched roof shall be provided around the
interior courtyard.
(c) All roof -mounted mechanical equipment shall
be architecturally screened from Interstate
5. Said screen design to be integrated with
overall building design.
9. Building Elevations - The following modifications
shall be incorporated into the final working
drawings:
(a) First floor windows shall be multi -pane,
similar to that on the remainder of the
building.

(b) Stucco detail on the upper floor should be
deleted.
10. Stucco Finish - Stucco finish shall be a smooth
trowel "mission" style finish.
11. Water - Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of the
Capistrano Valley Water District. Such
distribution facilities and appurtenances shall be
approved by the County Fire Marshal.
12. Slopes - All manufactured slopes shall be designed
and constructed in accordance with Section 9-3.505
and 9-4.112 of the Municipal Code. All such
slopes shall be 2:1 ratio or flatter.
13. Other Improvements - Driveways, pedestrian ways,
bikeways, equestrian trails, utility
undergrounding, street lights, traffic signals,
flood protection, drainage facilities, and
sanitary sewers shall be located and constructed
in accordance with Article 9-4.1 (Design Standards
and Requirements) of the Municipal Code and
adopted City policy.
14. Geotechnical Study - A geotechnical feasibility
study shall be completed to determine the seismic
safety and soils stability of all proposed grading
and development within the project. The report
shall be reviewed and approved by the City
Engineer prior to issuance of a grading permit.
15. Fees - All required fees shall be paid prior to
issuance of any building permit.
