Resolution Number 83-4-5-2RESOLUTION NO. 83-4-5-2 OPPOSING IMPOSITION OF SANCTIONS UPON SOUTH COAST AIR BASIN A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, OPPOSING IMPOSITION OF SANCTIONS BY ADMINISTRATOR OF THE ENVIRONMENTAL PROTECTION AGENCY UPON THE SOUTH COAST AIR BASIN WHEREAS, the City of San Juan Capistrano is located within the South Coast Air Basin; and, WHEREAS, the South Coast Air Basin stands to lose federal funds for transportation improvements, sewage treatment facilities, air quality planning and highway repair and construction if monetary sanctions are imposed by the Administrator of the Environmental Protection Agency; and, WHEREAS, the South Coast Air Basin, already hard hit by unemployment, stands to lose more jobs if a construction ban on new or modified major stationary sources is imposed by the Administrator of the Environmental Protection Agency; and, WHEREAS, the imposition of such sanctions would be counterproductive and could lead to worsened air quality and water quality; and, WHEREAS, the imposition of such sanctions is not warranted because the South Coast Air Quality Management District and the Southern California Association of Governments have approved and submitted to the EPA the most comprehensive, technically sophisticated and stringent air quality management plan in the nation, a plan which met all Clean Air Act and Environmental Protection Agency policy requirements and which has been praised as one of the best in the country; and, WHEREAS, in implementing this plan, the SCAQMD is taking every reasonable measure to reduce emissions and thereby attain air quality standards at the earliest possible date; and, WHEREAS, each year the SCAQMD has demonstrated progress in emission reductions and improved air quality and expects to continue to demonstrate additional progress; and, WHEREAS, the EPA may propose additional measures not included in the SCAQMD plan or even an alternative plan to meet federal clean air standards and has not done so; and, WHEREAS, in view of the progress made thus far in the South Coast Air Basin and in view of the commitment to clean air demonstrated in the plan submitted to the EPA by the SCAQMD, the imposition of sanctions upon the South Coast Air Basin is unjustified. -1- NOW, THEREFORE, BE IT RESOLVED that the City of San Juan Capistrano opposes the imposition of sanctions by the Administrator of the Environmental Protection Agency upon the South Coast Air Basin. BE IT FURTHER RESOLVED that the City of San Juan Capistrano urges the Administrator to approve the air quality management plan submitted in 1982 by the SCAQMD so that progress - toward cleaning up the air in the South Coast Air Basin can continue forthwith.
