Resolution Number 85-3-19-2341, RESOLUTION NO. DETERMINING EIR 85-3-19-2 T REOUIRED - CONDITIONAL A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DETERMINING THAT AN ENVIRONMENTAL IMPACT REPORT IS NOT REQUIRED FOR CONDITIONAL USE PERMIT 85-1 (SYCAMORE TRAILS STABLES/HANSON) WHEREAS, the applicant, Ronald B. Hanson, 26282 Oso Road, San Juan Capistrano, has submitted an application to expand existing facilities to include a lot line adjustment of a 5.476 -acre parcel directly adjacent to the south of the site, remove old western arena and install larger open arena, install 160 box stalls with wash racks and hot walker and construct a covered arena; and, WHEREAS, on February 26, 1985, the Planning Commission, after conducting a public hearing, determined that an environmental impact report addressing the issues of dust, noise, circulation, lighting, odor, and land use compatibility should be prepared; and, WHEREAS, there is no substantial evidence that the above -noted impacts will have a significant impact to the environment as a result that mitigation measures have been implemented into the project design which have reduced any potential impacts to an insignificant level; and, WHEREAS, the City Council, after holding a duly -noticed public hearing, hereby finds and determines as follows: Section 1. There will be no adverse impacts to the environment as a result of the expansion of the existing project and, therefore, cause a Negative Declaration to be prepared. Section 2. Mitigation measures have been implemented into the project design which will reduce any potential impacts to the environment to an insignificant level. -1- 3 4 2 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds that the preparation of an environmental impact report for Conditional Use Permit 85-1 is not required.
