RESOLUTION NO. 85-2-5-4
SITE PLAN REVIEW 85-2 (SOLAG)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA,
CONDITIONALLY APPROVING SITE PLAN REVIEW 85-2,
A MINOR MODIFICATION TO A NONCONFORMING USE
IN THE LOS RIOS PRECISE PLAN AREA (SOLAG)
WHEREAS, the applicant, Tom Trulis, 33595 Via
Corvalian, Dana Point, California, has submitted a request to
construct a 2,142 square foot open shed for vehicle maintenance
that would replace an existing 1,620 square foot structure
located on the westerly portion of the property at 31735 Los Rios
Street; and,
WHEREAS, the City's Environmental Review Board has
determined that the nature of the project involves a minor
modification to an existing land use and is therefore
categorically exempt and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the City's Los Rios Review Committee has
reviewed and considered the nature of the project and forwarded
it to the City Council recommending approval subject to certain
conditions; and,
WHEREAS, the City Council does hereby find and
determine as follows:
1. The proposal will not interfere with the orderly
transition of land uses, in accordance with the
Los Rios Precise Plan, in that the current
nonconformity is considered an interim use until
the property is acquired for park purposes by the
City and/or Community Redevelopment Agency; and,
2. The proposal will not materially contribute to
significant environmental impacts in that the
proposed structure will not intensify the use of
the property from that currently existing; and,
3. The proposal is minor and incidental to the
existing nonconformity in that the intensity of
the use or the volume of business will not be
increased by the replacement structure.
NOW, THEREFORE, BE IT RESOLVED that the City Council
does hereby approved Site Plan Review (SPR) 85-2, subject to the
following conditions:
1. Expiration of Approval - Per Section 9-2.305 of
the Municipal Code, this project development
approval shall expire on February 5, 1986, one
year from City Council approval date. If no
building permit has been issued by that date, the
development approval shall become null and void.

2. Building Plans - Building plans submitted with
this approval shall be considered precise. Any
changes or modification to the plans shall require
review by the City Council.
3. Structural Removal - Upon acquisition of the
property by either the City and/or Community
Redevelopment Agency, the structure shall be
removed at no cost to the City or Agency.
4. Property Appraisal - The applicant shall enter
into an agreement with the City that the costs of
the proposed improvements will not be incorporated
as a part of the property appraisal or credited
towards relocation assistance.
5. Driveway Improvements - The applicant shall
construct a paved access driveway or equivalent
material approved by the City Engineer. Said
driveway shall be a minimum 100 feet in length and
20 feet wide.
