Resolution Number 84-9-4-439 RESOLUTION NO. 84-9-4-4 TEMPORARY OFFICES FOR POLITICAL PARTIES (TEMPORARY USES AND STRUCTURES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, EXPANDING THE LIST OF TEMPORARY USES AND STRUCTURES OF SECTION 9-3.608 OF THE MUNICIPAL CODE TO ALLOW TEMPORARY OFFICE BUILDINGS FOR POLITICAL PARTY CAMPAIGN HEADQUARTERS WHEREAS, Section 9-3.608 of the Municipal Code allows the City Council to expand the list of temporary uses permitted by adoption of a resolution; and, WHEREAS, the City Council determines that political parties are civic, nonprofit organizations that may have difficulty in securing temporary building office space to house campaign headquarters, and it would be appropriate to provide flexibility within the Municipal Code to allow such organizations to receive consideration for locating within temporary buildings for a designated period of time prior to a national election; and, WHEREAS, the City Council does hereby further find and determine as follows: 1. The expansion of permitted temporary uses as defined by this Resolution is consistent with the goals, policies and objectives of the General Plan; 2. The establishment of subject use provides an important civic and community function regarding the democratic process; and, 3. The subject temporary use would be consistent and compatible with other permitted uses within the base zoning district regulations. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby expand the list of temporary uses and structures defined by Section 9-3.608 of the Municipal Code to include "temporary offices for political parties" subject to the following conditions: 1. Said temporary use shall not be established more than 60 days prior to a national election and shall be removed within ten (10) days following the election. 2. Location of both the site and temporary unit along with parking and any proposed signs shall be approved by the Director of Community Planning and Development. -1- 40 3. All ingress and egress to the property where the temporary structure is to be located shall be approved by the City Engineer. 4. Said temporary use shall be established only in the CM (Commercial Manufacturing), CN (Neighborhood Commercial), CG (General Commercial), or PC (Planned Community) Districts - where commercial uses are principal permitted uses. 5. Said temporary structure shall not exceed 750 square feet in building area.
