Resolution Number 85-5-21-115 RESOLUTION NO. 85-5-21-1 APPROVING CONDITIONAL USE PERMIT 85-1 (SYCAMORE TRAILS STABLES/HANSON) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING ' CONDITIONAL USE PERMIT 85-1, AUTHORIZING EXPANSION OF AN EXISTING EQUESTRIAN STABLE FACILITY AT 26282 OSO ROAD (SYCAMORE TRAILS STABLES/HANSON) WHEREAS: 1. The applicant, Ronald B. Hanson, 26282 Oso Road, San Juan Capistrano, California, has submitted an application for a Conditional Use Permit to establish an expansion of an existing equestrian stable facility located at 26282 Oso Road in the GM (Growth Management) District. 2. The City Council and the Environmental Review Board has determined that the proposed project will not have a significant effect on the environment, has accordingly issued a Negative Declaration for the project, and has otherwise carried out all requirements of the California Environmental Quality Act; and, 3. A public hearing has been duly noticed and held to receive public testimony on the application. 4. The City Council does hereby find and determine as follows: a. The proposed expansion is consistent with the goals, policies, and objectives of the General Plan. b. The equestrian land use is in conformance with the provisions of Title 9 (Land Use) of the Municipal Code. C. The land use is compatible with existing and proposed uses within the immediate vicinity. d. The subject property is capable of accommodating the equestrian facility expansion and its associated development. NOW, THEREFORE, BE IT RESOLVED, that based upon the preceding findings, the City does hereby approve Conditional Use Permit 85-1, subject to the following conditions: -1- 16 1. This Conditional Use Permit approval shall apply only to those plans specifically reviewed by the Planning Commission. Final working drawings shall be consistent with said plans reviewed by the Planning Commission. The working drawings shall be reviewed and approved by the Director of Community Planning and Development prior to building permit plan check to insure such consistency. 2. All structures built or located on the site shall comply with applicable City requirements, including valid building permits obtained for all construction. 3. This Conditional Use Permit shall authorize the existing equestrian stable to include: removal of existing western arena and construction of open arena, installation of 160 box stalls, wash racks and hot walker and the installation of covered arena. 4. Development of specific improvements shall be made in substantial compliance with the approved master plan of development. 5. Landscaping and irrigation plans shall be submitted to and approved by the Director of Community Planning and Development within six (6) months of the approval of the permit. Said landscaping shall be installed to the satisfaction of the Director of Community Planning and Development prior to the issuance of any certificate of use and occupancy for the new facilities approved by this permit. Landscaping shall be provided from Oso Road to the new boundary as defined by the lot line adjustment. The landscaping shall provide a solid screen between the project and Avenida de la Vista. Plant materials shall be those as noted on the site plan. In addition, the applicant shall provide an automatic irrigation system for the maintenance of the plant materials. 6. There shall be no night lighting on the new open arena. In addition, existing lighting shall be _ tested and shielded in such a manner that the light source is not visible from the project boundary. 7. Adequate dust control practices shall be carried out to limit blowing dust and sand to any off-site property, in accordance with Section 9-3.621 of the Land Use Management Code. -2- I '�f 8. The applicant shall install a speaker system that will limit the noise to a specific site location. The system design shall be approved by the Director of Community Planning and Development. The sound system shall have a reading level of 45 dBA as measured from the project boundary. The system shall be tested for compliance by the Department of Community Planning and Development prior to any newly constructed structures being used or operated. The provision of the 45 dBA is to be done on a trial basis for a period of six (6) months. At this time staff will report back to the Planning Commission noting their findings. The dBA level may be modified as a result of the report. 9. All requirements of Section 9-3.620 of the Land Use Management Code shall be satisfied by each improvement proposed at the facility. 10. The facility shall be satisfactorily comply with all environmental sanitation requirements, as required by the Orange County Health Department. 11. Review of compliance with the foregoing conditions of approval attached to the operation of this equestrian facility shall be conducted annually by the Director of Community Planning and Development. Failure to comply satisfactory with any of the conditions contained herein shall be the basis for the revocation of this Conditional Use Permit by the Planning Commission. 12. The applicant shall dedicate an easement for emergency access purposes from Oso Road to the new property boundary as defined by the lot line adjustment. An irrevocable offer of dedication shall be made to the City for public access purposes. 13. The site plan shall be revised to move the open area and barn further west to accommodate the access easement. 14. All new structures shall match materials and colors of structures on existing facilities. 15. The applicant shall pave the access road from Oso Road to present access road along Avenida de la Vista. Paving shall be 18 feet in width. Paving shall be in place prior to any new facilities being used or occupied. 16. Livestock, other than horses, shall not be kept at the project site. -3- 17. No building permit shall be issued until all conditions of approval have been met to the satisfaction of the Director of Community Planning and Development. 18. Access and egress to the site from Avenida de la Vista shall be for emergency purposes only. The applicant shall revise the site plan calling out the means and method of limiting the accessways.
