RESOLUTION NO. 86-8-19-2
CONTROL 85-3 - JUNIPERO SERRA PARTN
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING
MODIFICATION TO ARCHITECTURAL CONTROL 85-3, A PROPOSAL
TO CONSTRUCT A 32,127 -SQUARE -FOOT OFFICE COMPLEX
LOCATED AT THE INTERSECTION OF JUNIPERO SERRA ROAD AND
RANCHO VIEJO ROAD (SAN JUAN CORPORATE PLAZA)
WHEREAS, the applicant, Junipero Serra Partnership, #1 Brookhollow, Santa
Ana, CA 92705, has submitted an application for approval of a 32,127 -square -foot office
complex; and,
WHEREAS, the City's Architectural Board of Review and Planning
Commission have reviewed the project and forwarded it to the City Council
recommending approval, subject to certain conditions; and,
WHEREAS, the Planning Commission hereby finds and determines as follows:
The project, as consistent with the applicable goals, objectives, and
policies of the General Plan.
2. The project is designed and conditioned, is consistent with all applicable
requirements of Title 9 (Land Use) of the Municipal Code.
WHEREAS, on July 15, 1986, the City Council certified the Environmental
Impact Report prepared for the project as complete.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano, does hereby approve Architectural Control 85-3, subject to the
following conditions:
1. Expiration of Approval - Per Section 9-2.305 of the Municipal Code, this
project development approval shall expire on August 19, 1988,-i.e., two
years from the City Council approval date. If no building permit has
been issued for the project by that date, the development approval shall
become null and void.
2. Building Plans - Final building plans (working drawings) shall be reviewed
by the Architectural Board of Review (ABR) and shall be approved only if
said Board determines that the working drawings are consistent with the
concept plans approved with this resolution.
3. Landscape Plans - Final landscape and irrigation plans shall be reviewed
by the Planning Commission and shall be approved only if the Director
determines that said plans are consistent with the concept plans
approved with this resolution. Berming at a 2:1 slope shall be
incorporated at the west elevation. The applicant shall review the
landscape plan for the south elevation to include specific numbers, types
of species and minimum height specimen trees that will buffer the large
wall plan.

4. Sign Program - The final project sign program shall be
subject to
Planning Commission approval prior to Phase III review
Condition No. 2) and shall be limited to one sign.

5. Vehicular Access Rights - Vehicular access rights to all primary,
secondary, and communter highways shall be released and relinquished to
the City except at street intersections.
6. Public Streets - The following public streets shall be designed,
constructed, and dedicated in accordance with Section 9-4.103 of the
Municipal Code:
a. Rancho Viejo Road
7. Traffic Signal - The developer shall design and install a traffic signal at
the intersection of Rancho Viejo Road and Junipero Serra Road in
accordance with Section 9-4.108 of the Municipal Code. A
reimbursement agreement addressing the applicant's contribution
towards the pro rate share of the signal shall be prepared by the City
Engineer.
8. Historic Depiction Program - The fountain shall incorporate in design a
representation of the City's heritage. The final fountain design shall
receive advisory input by the Architectural Board of Review and the
Cultural Arts and Heritage Commission. The Planning Commission shall
give final approval of the work. Following project approval, a detailed
sketch and/or model of the work, including identification lettering, if
any, shall be approved by the City Council.
9. Landscaping Maintenance - Developer shall enter into an agreement for
the maintenance of landscaping located in the public right-of-way for
Rancho Viejo Road. Landscaping shall be maintained for the perpetuity
of the project.
10. Rancho Viejo Road - Should the project to the north not be developed
prior to completion of said project, the applicant shall improve Rancho
Viejo Road in such a manner so as to accommodate a southbound left -
turn pocket and enter into an agreement with the City for these
improvements. This agreeement shall be prepared by the City Engineer.
11. Grillwork - Prior to any further installation of grill work over the arched
garage windows, said grillwork shall be submitted to the Architectural
Board of Review for comments and approval.
12. Roof -Mounted Equipment - No roof -mounted equipment shall be allowed
on the project site. -
13. Building Finish Colors - The following finish colors are to be incorporated
as part of the final working drawings; any modification to said pallete
shall be reviewed and approved by the Planning Commission.

BE IT FURTHER RESOLVED, that based upon the preceding findings, the City
Council does hereby approve modification to Architectural Control 85-3.
