RESOLUTION NO. 86-7-15-4
TENTATIVE PARCEL MAP 86-179 (LACOUAGUE/RIVENDELL)
A RESOLUTION`OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING TENTATIVE PARCEL
MAP 86-179 (LACOUAGUE/RIVENDELL)
WHEREAS, the applicant, Rivendell Management Group,
Ltd., 10318 - 82 Avenue, Suite 300, Edmonton, Alberta, Canada,
T6E 1Z8, has submitted Tentative Parcel Map 86-179, proposing to
subdivide approximately 263 acres of land into parcels of 4.1 and
257.9 acres, located on Assessor's Parcels Nos. 124-223-38 and
124-223-39; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will have a significant
effect on the environment, has required the preparation of an
Environmental Impact Report, which report has been certified as
final by the City Council per Resolution No. 86-6-17-2, and has
otherwise carried out all requirements of the California
Environmental Quality Act; and,
WHEREAS, the City Planning Commission has forwarded the
tentative parcel map to the City Council recommending approval;
and,
WHEREAS, a public hearing has been duly advertised and
held to review and receive public testimony on the application;
and,
WHEREAS, the City Council of the City of San Juan
Capistrano finds and determines as follows:
1. The proposed project, as conditioned, and its
design and improvements are consistent with the
2.0 General Open Space and 1.1 Very Low Density
Residential designation on the General Plan Map
and is otherwise consistent with all other
l Elements of the General Plan, including:
a. Provision for improvements and dedication of
ultimate right-of-way for San Juan Creek Road
and Avenida Siega as per the Circulation
Element; and,
b. Provision for a multi -phase testing program
for CA -ORA 243 in accordance with the
Historic/Archaeological Element.
The proposed project, as conditioned, conforms to
all applicable requirements of Title 9 of the
City's Municipal Code (Land Use) and is consistent
with the approved Comprehensive Development Plan.

3. The project site is physically suitable for the
type and density of the proposed development.
4. The design and improvements of the proposed
project will not cause substantial environmental
damage, nor will said design or improvements
avoidably injure wildlife or their habitat.
5. The design or improvements of the proposed project
will not cause serious public health problems.
6. The design or improvements of the proposed project
will not conflict with easements acquired by the
public at large for access through or use of
property within the proposed project.
7. The design or improvements of the proposed project
will not interfere with the maintenance or
preservation of an historical site as conditioned.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby approve Tentative
Parcel Map 86-179, subject to the following conditions:
1. Revised Map - Tentative Parcel Map 86-179 shall be
revised to show two parcels consisting of Parcel 1
(4.1 acres) and Parcel 2 (257.9 acres). Parcel 2
shall have a note added that reads . . . "not a
building site, for reconveyance purposes only."
2. Improvement Certificate - Pursuant to provisions
of Section 66411.1 of the Subdivision Map Act, a
notice recorded on the Final Parcel Map shall be
placed over Parcel 2 which states that improvement
conditions placed on Tentative Tract 12633 shall
be ratified prior to processing any subsequent
development of Parcel 2.
