Resolution Number 86-6-17-1145 RESOLUTION NO. 86-6-17-1 TENTATIVE PARCEL MAP 86-108 (PATTERSON) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 86-108 (PATTERSON) WHEREAS, the applicants, Mr. and Mrs. Bruce Patterson, 31471 Aguacate Road, San Juan Capistrano, California, have submitted Tentative Parcel Map 86-108 proposing to subdivide approximately 3.2516 acres of land into two residential lots, located on Assessor's Parcel No. 649-101-22; and, WHEREAS, the City's Environmental Review Board has determined that the proposed project will not have a significant effect on the environment, has accordingly issued a Negative Declaration for the project, and has otherwise carried out all requirements of the California Environmental Quality Act; and, WHEREAS, the City Planning Commission has forwarded the proposal to the City Council recommending approval; and, WHEREAS, a public hearing has been duly advertised and held to review and receive public testimony on the application; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1. The proposed project, as conditioned, and its design and improvements are consistent with the 1.1 (Very Low Density) designation on the General Plan Map and is otherwise consistent with the Parks and Recreation Element of the General Plan. 2. The proposed project, as conditioned, conforms to all applicable requirements of Title 9 of the City's Municipal Code (Land Use). 3. The project site is physically suitable for the type and density of the proposed development. 4. The design and improvements of the proposed project will not cause substantial environmental damage, nor will said design or improvements avoidably injure wildlife or their habitat. -1- 146 5. The design or improvements of the proposed project will not cause serious public health problems. 6. The design or improvements of the proposed project will not conflict with easements acquired by the public at large for access through or use of property within the proposed project. 7. The design or improvements of the proposed project will not interfere with the maintenance or preservation of a historical site. 8. The proposed subdivision will not have a significant impact on the environment and has, therefore, certified the issuance of a Negative Declaration. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve Tentative Parcel Map 86-108, subject to the following conditions: 1. Private Streets - The following private streets shall be designed and constructed in accordance with Section 9-4.103 of the Municipal Code: An improved all-weather surface accessway (either a hammerhead or cul-de-sac) shall be provided to Parcel 2 prior to building permit issuance. 2. Water Supply - Adequate water supply and hydrant shall be available to Parcel 2 upon issuance of a building permit. 3. Irrevocable offers - The City shall accept the Jones property irrevocable offer and a portion of the Spaulding irrevocable offer to allow improvements to Via Estelita prior to finalization of the map. 4. Access Driveway - An access driveway shall be provided from Parcel 2 to the accepted portion of Via Estelita. In addition, the parcel map shall provide an easement across Parcel 2 to serve Parcel 1. 5. Immediate Im rovements to Via Estelita - The applicant shall provide a cash payment for those necessary improvements on Via Estelita, covering the Jones frontage and Parcel 2 frontage. -2- 147 6. Ultimate Improvements to Via Estelita - Property owners of Parcels 1 and 2 shall enter into an agreement and cooperate in the ultimate improvements to Via Estelita including possible provision of a cul-de-sac at the terminus of the existing improvements.
