Resolution Number 86-5-6-8RESOLUTION NO. 86-5-6-8 v APPROVED DEVELOPMENT P A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, A➢PROVING MODIFICATIONS TO AN APPROVED DEVELOPMENT PLAN FOR A SINGLE-FAMILY RESIDENCE LOCATED AT 31891 LOS RIOS STREET IN THE LOS RIOS PRECISE PLAN AREA (VASQUEZ) WHEREAS, the property owners, Mr. and Mrs. Jeff Vasquez, are constructing a residence located at 31891 Los Rios Street; and, WHEREAS, plans for the residence were conditionally approved by the Planning Commission on February 26, 1985, in accordance with the adopted Los Rios Precise Plan; and, WHEREAS, the property owners submitted a request to modify the approved building plans on January 20, 1986; and, WHEREAS, the Los Rios Review Committee considered the request at their meeting of February 27, 1986, and forwarded a recommendation to the Planning Commission to deny the proposed modification; and, WHEREAS, the Planning Commission reviewed the request and partially approved the request by allowing the attic area to be converted to habitable space and denying certain changes to the exterior elevations, including a gable over a porch, round window, skylight, and balcony off the attic; and, WHEREAS, the appellant, Vicki Ryan, 32742 Alipaz Street, Space 23, San Juan Capistrano, California, appealed the decision of the Planning Commission to allow conversion of the attic area to habitable living space; and, WHEREAS, the property owners subsequently appealed the decision of the Planning Commission regarding changes to the exterior building elevations. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby take the following actions on the appeal: 1. Approve the proposed round window in that the Los Rios Precise Plan requires the restoration of the structure's authentic architectural details, in which case the original windows for the residence were square. -1- 8 2. Approve the proposed gable above the front entrance based upon the finding that Section 3.4.3(B)(2) of the Los Rios Precise Plan states that there shall be no additions or alterations to the front of the building that are not in keeping with the historic character of the structure. This proposed modification would not be consistent with the design of the original porch/front entrance for the building. 3. Approve the second level balcony based upon the finding that the exterior elevation changes the appearance of the originally approved plans. 4. Approve the interior modifications to convert the building's existing attic space to a livable loft area, including a bathroom and large closet. 5. Confirm the action of the Planning Commission to approve a proposed deck and stairway, subject to a reduction in size of the deck and stairway so that it is in scale with the building and surrounding residences, said revised plan to be reviewed and approved by the Director of Community Planning and Development. 6. Confirm the action of the Planning Commission to approve the revision of the proposed basement -level entrance to the rear elevation as submitted. 7. Confirm the action of the Planning Commission to approve the removal of the retaining wall on the south side yard and conform to the existing grade on the left building elevation.
