RESOLUTION NO. 87-6-2-4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING EXCEPTION TO
MUNICIPAL CODE SECTION 9-3.602, "PARKING FACILITY DESIGN
STANDARDS", TO REDUCE PARKING STALL WIDTH FROM 9-1/2
FEET TO 9 FEET (PRICE CLUB)
WHEREAS, the applicant, the Price Company, P.O. Box 85466, San Diego,
California, 92138, has submitted an application for an exception to Municipal Code
Section 9-3.602, "Parking Facility Design Standards," to reduce the parking stall width
from 9-1/2 feet to 9 feet for a 22+ acre wholesale/retail commercial center located on
Assessor's Parcel Nos. 121-254-06, -07, and -08 in the PD (Planned Development)
District; and,
WHEREAS, the City's Environmental Review Board has determined that the
ultimate development of this property will have a significant effect on the environment,
has required the preparation of an Environmental Impact Report, which Report has been
certified as complete by the City Council, and has otherwise carried out all requirements
of the California Environmental Quality Act; and,
WHEREAS, the Planning Commission denied the exception request by PC
Resolution 87-4-28-1; and,
WHEREAS, in consideration of this matter under an appeal filed by the project
applicant, the City Council, pursuant to Municipal Code Section 9-3.602(d)(1), hereby
finds and determines as follows:
1. No useful purpose would be served by the requirement in that the
proposed parking stall width has been demonstrated by the applicant to
work satisfactorily for maneuvering and parking of vehicles and it
provides sufficient room for loading and unloading of merchandise.
2. Strict adherence to the City requirement would potentially entail a
hardship to the property owner because the use is unique in its excessive
demand for parking. Parking in addition to the Code minimums will be
needed to serve the use, thus provision must be made for the largest
possible number of spaces.
3. The intent of the requirement is being met in the concept and design of
the total project in that adequate numbers of parking spaces are being
provided to accommodate the proposed use and the applicant has
demonstrated their function and usability.

NOW THEREFORE, BE IT RESOLVED, that, based upon the preceding findings,
the City Council of the City of San Juan Capistrano does hereby approve the exception
to iMuncipal Code Section 9-3.602.
