Resolution Number 87-4-21-6RESOLUTION NO. 87-4-21-6 APPLICATION TO EXPAND SPHERE OF INFLUENCE AND ANNEX PROPERTY SOUTH OF CITY BOUNDARY (SOUTHSIDE ANNEXATION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPLYING TO THE ORANGE COUNTY LOCAL AGENCY FORMATION COMMISSION FOR A SPHERE OF INFLUENCE EXPANSION AND ANNEXATION, AND ACCEPTING THE EXCHANGE OF PROPERTY TAXES WHEREAS, the City desires to annex territory south of its boundary in order to effectively manage drainage, sewer service, water service, traffic access, and other municipal services for said area; and, WHEREAS, said territory already lies within the City's subsidiary Capistrano Valley Water District; and, WHEREAS, Section 99(B) of the California Revenue and Taxation Code requires affected agencies to agree to accept negotiated exchange of property tax revenues prior to the effective date of a jurisdictional change. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, does hereby apply pursuant to Government Code Section 56650 et seq, to the Local Agency Formation Commission for annexation of the territory shown on Exhibit A, attached hereto. The application, including the plan for services, is enclosed as Exhibit B, also attached hereto. BE IT FURTHER RESOLVED, that in accordance with LAFCO policy against annexations outside a jurisdiction's sphere of influence, the City hereby concurrently requests an expansion of its sphere of influence to add the subject territory as shown on Exhibit A, attached hereto. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano deems the territory proposed for annexation to be undeveloped under the definitions of the Master Property Tax Agreement dated October 28, 1980, and hereby agrees to accept the exchange of property tax revenue with the County of Orange for this annexation pursuant to said Master Property Tax Agreement.
