Resolution Number 87-12-1-1RESOLUTION NO. 87-12-1-1 347 TENTATIVE PARCEL MAP 87-367 (HOME FEDERAL) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 87-367 (HOME FEDERAL) WHEREAS, the applicant, Home Federal Savings and Loan Association of San Diego, 625 Broadway, Suite 506, San Diego, California, has submitted Tentative Parcel Map 87-367, proposing to subdivide approximately 2.1 acres of land into 2 commercial lots, located on Assessor's Parcel No. 668-242-10; and, WHEREAS, the City's Environmental Review Board has determined that the proposed project is Categorically Exempt (Class 15) from the requirements of the California Environmental Quality Act; and, WHEREAS, the City Planning Commission has forwarded the Tentative Parcel Map 87-367 to the City Council recommending approval; and, WHEREAS, a public hearing has been duly advertised in the Capistrano Valley News and held to review and receive public testimony on the application; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1. The proposed project, as conditioned, and its design are consistent with the 3.1 (General Commercial) designation on the General Plan map and is otherwise consistent with all other elements of the General Plan. 2. The proposed subdivision, as conditioned, conforms to all applicable requirements of Title 9 of the City's Municipal Code (Land Use). 3. The project site is physically suitable for the type and density of the proposed subdivision in that it is fully developed. 4. The proposed subdivision will not cause substantial environmental damage; nor will said design or improvements avoidably injure wildlife or their habitat. 5. The proposed subdivision will not cause serious public health problems. 6. The proposed subdivision will not conflict with easements acquired by the public at large for access through or use of property within the proposed easement. 7. The proposed subdivision will not interfere with the maintenance or preservation of an historical site. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, does hereby approve Tentative Parcel Map 87-367, subject to the following conditions: -1- • 1. Expiration of Approval - Per Section 9-2.304 of the Municipal Code, this tentative parcel map shall expire on November 17, 1989--i.e. two years from the City Council approval date. If no final map is recorded prior to that date, the tentative parcel map shall become null and void. Conditions Covenants and Restrictions - A set of conditions, covenants, and restrictions CC&R's shall be prepared and implemented for the _ project. The CC&R's shall include, at a minimum, provisions for common exterior building, landscaping, and site improvement maintenance and repair. 3. Reciprocal Access Agreement_ - A reciprocal easement agreement for parking and access purposes shall be executed between and among the subdivided parcels and recorded on the property, prior to approval of a final map. No modifications shall be made to the agreement or the existing circulation system, and/or parking stall layout without prior approval of the City. 4. Water and Sewer Facilities - Each parcel shall be required to have separate water and sewer services. PASSED, APPROVED, AND ADOPTED this 1st day of December, 1987. ANTHONY L.
