Resolution Number 87-7-7-135 RESOLUTION NO. 87-7-7-1 LOS RIOS PRECISE PLAN AMENDMENT 87-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE LOS RIOS PRECISE PLAN TO ELIMINATE THE BAZAAR, CREATE THE HISTORIC COMMERCIAL DISTRICT AND CLARIFY THE DEVELOPMENT STANDARDS FOR THE LOS RIOS HISTORIC DISTRICT WHEREAS, the City of San Juan Capistrano adopted the Los Rios Precise Plan per Section 9-3.422 of the Municipal Code on February 15, 1978; and, WHEREAS, the Los Rios Review Committee held a public hearing and reviewed the amendment to the Los Rios Precise Plan and forwarded same to the Planning Commission on May 14, 1987; and, WHEREAS, the Planning Commission, on June 9, 1987, after a duly advertised public hearing, forwarded a recommendation to the City Council to approve the amendment to the Los Rios Precise Plan; and, WHEREAS, the City's Environmental Review Board has reviewed the proposed Precise Plan amendment and determined that the amendment is a minor change to the land use regulations and is therefore categorically exempt and has otherwise carried out all applicable provisions of the California Environmental Quality Act of 1970; and, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, California, does hereby amend the Los Rios Precise Plan to include the changes shown on Exhibit A. The exact language of the changes are included in Exhibit B made a part hereof by reference. The Plan and Amendment were prepared in accordance with Title 7, Chapter 3, Article 8 of the California Government Code. The Plan is amended based upon the following findings: 1. The amendment to the Los Rios Precise Plan is consistent with the SS (Special Study) designation of the Composite Land Use Map of the General Plan and is otherwise consistent with applicable goals, policies, and objectives of the General Plan and Citizen's Policy Plan. 2. The amendment to the Los Rios Precise Plan is in substantial conformance with the provisions of the previously adopted Los Rios Precise Plan. -1- 36 3. Eliminate the Bazaar use from the Park Bazaar District. 2. Eliminate all references to the Bazaar. 3. Create a new district entitled Historic Commercial District to provide limited low intensity commercial uses and establish development standards. 4. Designate all properties with frontage to Los Rios Street as Historic Residential District. 5. Modify the Historic Residential District development standards and regulations to allow for commercial use in conjunction with residential use, provided parking is provided on site. 6. Modify Land Use Map to establish new district boundaries. 7. Modify the Land Use and Park/Bazaar Elements to eliminate references to the Bazaar. The Park/Bazaar Element has been retitled Park/Central Area. 8. The existing Site Design Standards and Architectural Design Guidelines were clarified and included within a new subsection entitled "Supplementary District Regulations". 9. The Implementation Plan has been modified to eliminate references to the Bazaar and have it more accurately reflect our action program. 10. Establish specific development standards for the Low Density Residential District. 11. The Implementation Plan identifies a need for preparation of a lighting and sign program for the entire historic district and a Master Plan for Los Rios Park. AI:AI514872A EXHIBIT A
