Resolution Number 89-2-21-1433 RESOLUTION NO. 89-2-21-1 TO 2200' SOUTH OF SAN JUAN CREEK ROAD CAR WASH A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, REQUESTING THE ORANGE COUNTY TRANSPORTATION COMMISSION TO ALLOCATE ORANGE COUNTY UNIFIED TRANSPORTATION TRUST (OCUTT) FUNDS FOR CAMINO CAPISTRANO BETWEEN THE SOUTH CITY LIMIT AND 2200 FEET SOUTH OF SAN JUAN CREEK ROAD WHEREAS, Chapter 1512, Statutes of 1985, allows the Orange County Transportation Commission to allocate funds from the rapid transit reserve to local agencies for the improvement, construction, or repair of local streets and roads; and, WHEREAS, the Orange County Transportation Commission approved a $12 million OCUTT Streets and Roads Program on April 14, 1986, covering fiscal years 1986- 87 through 1988-89; and, WHEREAS, the program includes $148,820 in fiscal year 1988-89 for an overlay project on Camino Capistrano between the South City Limit and 2200' South of San Juan Creek Road. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano hereby requests that the Orange County Transportation Commission allocate $5,475.00 for construction engineering and, $68,436 for construction, for a total of $73,911.00 in OCUTT funds to the City. This request is in conformance with the OCUTT allocation process and does not exceed ninety percent (90%) of the OCUTT share of the construction contract. BE IT FURTHER RESOLVED, that the City of San Juan Capistrano agrees to fund its share of the improvement costs in fiscal year 1988-89 and any additional costs over the programmed OCUTT amount of $148,820. BE IT FURTHER RESOLVED, that the City of San Juan Capistrano has awarded the contract for the project on February 21, 1989, for $164,248.09. BE IT FURTHER RESOLVED, that the City of San Juan Capistrano has: 1. designed the project improvements in accordance with the City's design standards; 2. not acquired any additional right-of-way for the project; and, 3. completed and certified all required environmental documentation for the project. -1- BE IT FURTHER RESOLVED, that the remaining ten percent (10%) in OCUTT funds will be transferred to the City of San Juan Capistrano when construction is completed and a final report on the project is accepted by the Orange County Transportation Commission. The City of San Juan Capistrano agrees to submit the final report to the Orange County Transportation Commission within ninety (90) days after the City's acceptance of the improvements.
