TENTATIVE PARCEL MAP 88-227 (SPAULDING)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING VESTING
TENTATIVE PARCEL MAP 88-227 (SPAULDING)
WHEREAS, the applicant, G. Richard Spaulding, 31611 Sacarama Lane, San
Juan Capistrano, California, has submitted Vesting Tentative Parcel Map 88-227,
proposing to subdivide approximately 5.57 acres of land into 7 commercial parcels
located on Assessor's Parcel Nos. 668-101-01 and 668-101-02 and,
WHEREAS, the City's Environmental Review Board has determined that the
proposed project will not have a significant effect on the environment, has accordingly
issued a negative declaration for the project, and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the City Planning Commission has forwarded the tentative parcel
map to the City Council recommending approval; and,
WHEREAS, the City Council of the City of San Juan Capistrano finds and
determines as follows:
1. The proposed project, as conditioned, and its design and
improvements are consistent with the Quasi -industrial designation
on the General Plan map and is otherwise consistent with all other
elements of the General Plan.
2. The proposed project, as conditioned, conforms to all applicable
requirements of Title 9 of the City's Municipal Code (Land Use)
and is consistent with the approve concept plan, AC 88-6
(Spaulding).
3. The project site is physically suitable for the type and density of
the proposed development.
4. The design and improvements of the proposed project will not
cause substantial environmental damage; nor will said design or
improvements avoidably injure wildlife or their habitat.
5. The design or improvements of the proposed project will not cause
serious public health problems.
6. The design or improvements of the proposed project will not
conflict with easements acquired by the public at large for access
through or use of property within the proposed project.
7. The design or improvements of the proposed project will not
interfere with the maintenance of preservation of an historical
site.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano, does hereby approve tentative parcel map 88-227, subject to the
following conditions:
1. Reciprocal Access Agreements - Reciprocal access agreements
shall be provided for ingress, egress and parking between parcels.
2. Maintenance Association - A maintenance association shall be
formed which provides for the upkeep and maintenance of
common areas. CC&R's which create the association and define
duties and responsibilities shall be approved by the Director of
Community Planning and Development and shall be recorded
concurrently with the final parcel map.
3. Lands ca a Maintenance - The developer shall be responsible for
adequate y installing and maintaining all landscaping until such
maintenance may be assumed by the maintenance association.
4. Vehicular Access Rights - Vehicular access rights to all Paseo
Adelanto shall be released and relinquished to the City of San
Juan Capistrano, except at approved driveway locations.
5. SoilRe rt/Geotechnical FeasibilityStud - A soils
report geotechnical feasibility study shall be submitted to
determine the seismic safety and soils stability of all proposed
grading.
6. Drainage - Drainage facilities shall be construction per City of
San Juan Capistrano Master Drainage Plan and as shown on
improvement plans.
7. Grading Plan - A grading plan shall be submitted that shows
sewer, water, parkway/street improvements, and limits of work on
the site and shall be prepared by a civil engineer and meet the
approval of the City Engineer and Building Official.
8. Storm Run-off Study - The developer's civil engineer shall submit
a storm run-off study showing existing and proposed facilities,
hydraulic and hydrologic calculations and method of draining this
area and tributary areas without exceeding the capacity of any
street or facility on site or off site.
9. Public Improvements
The applicant shall financially participate in the following
improvements based upon the development's pro -rata share of
generated traffic impacts.
a. Traffic signal railroad preemption system on Del Obispo
Street between Alipaz Street and Camino Capistrano.
b. Del Obispo Street pedestrian bridge at Trabuco Creek.

C. Paseo Adelanto widening from Del Obispo Street to the. post
office area.
