A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING
ARCHITECTURAL CONTROL 87-2 (CHEVRON U.S.A., INC.) AND
APPEAL OF PLANNING COMMISSION RESOLUTION 87-8-11-1 TO
MAINTAIN THE WEST DRIVEWAY AND ESTABLISH A SELF -SERVE
GASOLINE STATION LOCATED AT 27112 ORTEGA HIGHWAY IN
THE CG (GENERAL COMMERCIAL) DISTRICT

WHEREAS, The applicant, Mr. Jerry Holmquist, Chevron U.S.A., Inc., P.O. Box
2833, La Habra, California 90631, has submitted an application for a site plan review to
establish a self -serve gasoline service station located at 27112 Ortega Highway in the CG
(General Commercial) District; and,
WHEREAS, the City's Environmental Review Board has determined that the
proposed project will not have a significant effect on the environment, has accordingly
issued a Negative Declaration for the project certified by the Planning Commission, and
has otherwise carried out ail requirements of the California Environmental Quality Act;
and,
WHEREAS, the City's Architectural Board of Review has reviewed the project
and forwarded it to the Planning Commission recommending approval subject to certain
conditions; and,
WHEREAS, the City's Traffic and Transportation Commission has reviewed the
project and forwarded it to the Planning Commission recommending approval subject to
certain conditions; and,
WHEREAS, the City's Planning Commission granted Conditional Use Permit
87-1 (Chevron U.S.A. Inc.) to allow for such use within the CG (General Commercial)
District; and,
WHEREAS, the City's Planning Commission approved AC 87-2 (Chevron U.S.A.
Inc.) subject to conditions, including a condition to close the west driveway; and,
WHEREAS, the applicant, Mr. Jerry Holmquist, has submitted an appeal to the
specific condition requiring the closure of the west driveway; and,
WHEREAS, the City Council finds and determines as follows:
a. The project is consistent with all applicable goals, objectives, and
policies of the General Plan.
b. The project, as designed and conditioned, is consistent with all
applicable requirements of Title 9 (Land Use) of the Municipal
Code.
C. Maintaining the west driveway for right -tum ingress only, in
conjunction with the implementation of the concept Circulation
and Traffic Management Plan for Ortega Highway will improve

262 existing conditions on Ortega Highway in the project vicinity and
reduce vehicular conflicts exiting the site at this driveway.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano, does hereby rescind Planning Commission Resolution No. 87-8-11-1
and approve AC 87-2 (Chevron U.S.A. Inc.) subject to the following conditions:
1. Expiration of Approval - Per Section 9-2.305 of the Municipal
Code, this project development approval shall expire on
September 6, 1990, i.e, two years from the City Council approval
date. If no building permit has been issued for the project by that
date, the development approval shall become null and void.
2. Building Plans - Final building plans (working drawings) shall be
reviewed by the Architectural Board of Review (ABR) and shall be
approved only if said Board determines that the working drawings
are consistent with the concept plans approved with this
resolution.
3. Landscape Plans - Final landscape and irrigation plans shall be
reviewed by the Director of Community Planning and
Development and shall be approved only if the Director
determines that said plans are consistent with the concept plans
approved with this resolution.
a. The raised curb landscaping areas along Ortega Highway
shall be expanded in size to lie within the roadway right-of-
way to provide a continuous 8 -foot -wide sidewalk area on
Ortega Highway along the entire project frontage.
b. The proposed redwood chips in the landscaped areas shall be
eliminated and replaced with ground cover.
C. A Eucalyptus Torquata shall be placed in the area behind the
trash enclosure.
d. Add vertical bush tree whose characteristics would provide
for mature growth within the designated planter areas.
4. Architecture - The elevations depicted in the Canopy Revision
Study shall be incorporated into the final working drawings.
5. Exterior Lighting - Plans for exterior lighting, including fixture
Ty—pe and locations, shall be reviewed by the Architectural Board
of Review and the Planning Commission prior to Phase III
review. Roof -mounted lighting shall be prohibited. Exposed
fluorescent lighting under the canopy shall be prohibited.
6. Parking and Circulation
a. The northerly stall of the spaces which face into the "air,
water, and light unit" shall be eliminated.

b. The small proposed "new planter" along the easterly
property tine shall be deleted and replaced with one
additional parking space.
C. The applicant shall provide a right -turn deceleration into the
project at the easterly driveway.
d. The easterly driveway approach shall be reconstructed per
City standard (OCEMA Standard 1210 modified) to the
satisfaction of the City Engineer.
e. The applicant shall design and construct a raised landscaped
median on Ortega Highway from the northbound 1-5 ramps to
Avenida De Los Cerritos.
f. The gasoline pumps shall be designed and constructed to
encourage traffic flow north to south.
Signs
a. The proposed monument sign shall be externally -illuminated
with an opaque background as required by Section 9-3.603 of
the Municipal Code.
b. The proposed monument sign shall be revised to be
specifically for pricing only, and shall not exceed 32 square
feet in size. No additional station identification will be
permitted.
C. Details for the Denny's directional sign on Ortega Highway
shall be reviewed and approved by the Director of
Community Planning and Development prior to installation
of said sign. The directional sign shall conform to all
applicable requirements of Section 9-3.603, Si ns, of the
Municipal Code.
8. Encroachment Permit - An encroachment permit shall be obtained
from Caltrans for all work within their right-of-way. A copy of
said permit shall be kept on file with the City Engineer and the
Permit Services Supervisor prior to issuance of building or grading
permits.
9. Improvement Plans - The applicant shall submit all necessary
improvement plans prepared by a Civil Engineer for work within
the public right-of-way including, but not limited to
parkway/street improvements, driveway approaches, sewer and
water connections. Said plans shall be prepared and improvements
constructed to the satisfaction of the City Engineer.

10. Dust Control - The applicant shall maintain the site in a "wet
down" condition to the degree necessary to prevent excessive
dust.
