Resolution Number 89-10-17-11�07 RESOLUTION NO. 89-10-17-1 APPROVING MODIFICATIONS TO TENTATIVE PARCEL MAP 87-306 (MEADOWS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING MODIFICATIONS TO TENTATIVE PARCEL MAP 87-306 (MEADOWS) WHEREAS, the applicant, Mr. T. J. Meadows, 31241 Andres Pico Road, San Juan California, has submitted Tentative Parcel Map 87-306, proposing to subdivide approximately 1.8 acres of land into 4 residential lots, located on Assessor's Parcel No. 649-271-63; and, WHEREAS, the City Council has previously approved Tentative Parcel Map 87-306 in accordance with the findings and conditions of Resolution No. 88-10-4-3; and, WHEREAS, the applicant has requested modifications to Condition Nos. 3 and 4 of said Resolution; and, WHEREAS, the City Planning Commission has forwarded this request to the City Council recommending approval; and, WHEREAS, the City Council of the City of San Juan Capistrano reaffirms and determines as follows: 1. The proposed project, as conditioned, and its design and improvements" are consistent with the 1.5 Medium High Density designation on the General Plan map and is otherwise consistent with all other elements of the General Plan. 2. The proposed project, as conditioned, conforms to all applicable requirements of Title 9 of the City's Municipal Code (Land Use) and is consistent with the provisions of Rezone 88-8 (Meadows). 3. The project site is physically suitable for the type and density of the proposed development. 4. The design and improvements of the proposed project will not cause substantial environmental damage; nor will said design or improvements avoidably injure wildlife or their habitat. 5. The design or improvements of the proposed project will not cause serious public health problems. 6. The design or improvements of the proposed project will not conflict with easements acquired by the public at large for access through or use of property within the proposed project. 7. The design or improvements of the proposed project will not interfere with the maintenance of preservation of an historical site. -1- NOVO, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, does hereby reaffirm its approval of Tentative Parcel Map 87- 306 and modifying its previous action, subject to the following conditions: 1. Expiration of Approval - Per Section 9-2.305 of the Municipal Code, this project development approval shall expire on October 4, 1992, i.e., two years from the City Council approval date. If the final map has not been recorded by that date, the development approval shall become null and void. 2. Home Warrant - The provisions of Chapter 8-6 of the Municipal Code Home Warranty Ordinance) shall apply to any person, firm or corporation selling or offering for sale within the project three or more dwelling units --not previously occupied for residential purposes --during any 12 -month period. 3. Development Review - Development plans for individual lots including grading, landscape and building plans shall be reviewed by the Planning Commission. In reviewing development plans for all lots, the Planning Commission is to ensure that the plant locations will not obstruct prominent views from the properties to the north and northwest. Proper notification shall be recorded with the subdivision. 4. Public Improvements a. The applicant shall design, construct and dedicate right-of-way for a 46 -foot cul-de-sac on Don Juan Avenue in accordance with City standards (OCEMA). b. Vehicular access rights to Don Juan Avenue shall be released or relinquished to the City of San Juan Capistrano, except at approved driveway locations. C. Dedicate appropriate easements to City of San Juan Capistrano for emergency and public security ingress and egress purposes. 5. Circulation and Access - The applicant shall dedicate appropriate easements to allow ingress/egress for parcels 2 and 4 over parcel 3. The proposed driveway for parcel 2 shall be eliminated. 6. Fees - The applicant may defer payment of applicable Park and Recreation fees and Sewer Capacity fees until such time that building permits are issued for the individual parcels. -2- 399 7. Archaeological Mitigation - A qualified archaeologist shall be retained by the applicant to monitor the initial on-site grading. PASSED, APPROVED, AND ADOPTED this 17th day of October , 1989. ARY L.
