APPROVING VESTING TENTATIVE TRACT MAP 10634

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING VESTING
TENTATIVE MAP 10634 (PUEBLO SERRA/ENTERPRISE
CONSTRUCTION)
WHEREAS, the applicant, Enterprise Construction Inc., 2955 East Main Street,
Irvine, California, has submitted Vesting Tentative Tract Map 10634, proposing to
subdivide approximately 30 acres of land, identified as Assessor Parcels 649-011-25 and
649-011-30, into five numbered lots and one lettered lot; and,
WHEREAS, the City's Environmental Review board has determined that the
overall Pueblo Serra Planned Community project, of which this application is a part,
would have a significant impact on the environment, has accordingly required preparation
of an environmental impact report, and has otherwise carried out all requirements of the
California Environmental Quality Act; and,
WHEREAS, the City's Planning Commission has forwarded the tentative tract
map to the City Council recommending approval; and,
WHEREAS, a public hearing has been duly advertised in the Capistrano Valley
News and held to receive and review public testimony on the application; and,
WHEREAS, the City Council of the City of San Juan Capistrano finds and
determines as follows:
1. The proposed subdivision, as conditioned, and its design and
improvements are consistent with the "Planned Community"
designation on the General Plan Map and with the goals, policies, and
objectives of the General Plan.
2. The proposed subdivision, as conditioned, is consistent with the
Planned Community (Comprehensive Development Plan 89-1) zoning
on the property and otherwise conforms to all applicable
requirements of Title 9 (Land Use) of the City's Municipal Code.
3. The project site is physically suitable for the type and density of the
proposed development.
4. The design and improvements of the proposed subdivision will not
cause substantial environmental damage; nor will said design or
improvements avoidably injure wildlife or their habitat.
5. The design of the proposed subdivision or the type of improvements
will not cause serious public health problems.
6. The design or improvements of the proposed subdivision will not
conflict with easements acquired by the public at large for access
through or use of property within the proposed project.

7. The design or improvements of the proposed project will not
interfere with the maintenance or preservation of an historical site.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of San Juan Capistrano, does hereby approve Vesting Tentative Tract Map 10634,
subject to the following conditions:
1. Expiration - In accordance with the State Subdivision Map Act,
unless an extension is approved by the City this tentative map shall
expire 24 months from the date of approval written hereinbelow.
2. Preliminary Grading Plans - Grading plan approval is not a part of
this tentative tract approval. Detailed preliminary grading plans for
each project to be built within the tract shall be approved by the
Planning Commission prior to Phase III review of working drawings.
3. Final Grading Plans - A final grading plan shall be submitted with
hydrology calculations, both prepared by a civil engineer, at the time
of submittal of street improvement plans and/or a final tract map.
The extent of topography of the grading plan shall be sufficient to
determine drainage impacts to adjacent properties.
4. Sycamore Preservation - Prior to issuance of any permit for grading
within the tract, or for improvements to Junipero Serra, Camino
Capistrano or Oso Road, the developer shall deposit a bond or similar
surety with the City in the form and amount to be approved by the
Director of Community Planning and Development and the City
Attorney, to ensure preservation of the two large landmark sycamore
trees near Junipero Serra Road and Oso Road. In addition, the
developer shall prepare a tree preservation program for both trees,
showing protection from grading operations, street improvements,
utility lines, and other construction impact. The tree protection plan
shall be approved by the Planning Commission prior to development.
5. Archaeology -Paleontology - The developer of each phase shall ensure
Th—at all mitigation measures listed in the environmental impact
report and the comprehensive development plan for the project
regarding preservation of archaeological and/or paleontological
resources are carried out in conjunction with grading and building
within the tract.
Landsca a and Wall Plans - Detailed landscape, street tree, and
fence wall plans shall be prepared for each phase of development
within the subdivision. Preliminary plans shall be approved by the
Planning Commission prior to issuance of the grading permit for the
applicable phase. Final working drawings shall be approved by the
City in accordance with standard procedures.
Landscaping Installation - No final building inspection shall be
conducted for any building within a given development phase in the
subdivision until all landscaping has been installed for that phase, per
approved plans, and approved by the Director of Community Planning
and Development.

8. Oso Road - Alignment of Oso Road shall be to the satisfaction of the
City Engineer.
9. Extension of Camino Capistrano - The subdivider shall realign and
improve Camino Capistrano from Junipero Serra Road northward to
existing Camino Capistrano at a point south of the Trabuco Creek
bridge, providing the necessary right-of-way can be obtained.
Improvements shall consist of two travel lanes with paved shoulders
and bike lanes, 40 feet edge -of -pavement to edge -of -pavement, with
necessary transition at the intersection with Junipero Serra Road to
provide a protected left -turn pocket. Said improvements shall be
carried out at the same time as realignment of Camino Capistrano
south of Junipero Serra Road. The cost of right-of-way acquisition
and road improvements may be subject to a reimbursement
agreement based on the estimated traffic generation of affected
projects.
10. Public Streets - The subdivider shall design, construct, and dedicate
the following streets in accordance with Section 9-4.103 of the
Municipal Code and the phasing schedule in Chapter 6 of the Pueblo
Serra Comprehensive Development Plan (CDP 89-1):
a. Oso Road to its ultimate width of 60 feet, providing sufficient
width for two travel lanes in each direction, from east of the
railroad right-of-way to realigned Camino Capistrano
b. Camino Capistrano to its ultimate scenic secondary highway
width of 104 feet (64 feet curb -to -curb) from Calle Chueca to
north of Junipero Serra Road, including an off-road bikeway on
the west side.
C. Junipero Serra Road to its ultimate width of 114 feet (84 feet
curb -to -curb) from 20 feet west of the Lot 4 (CN.1 site)
secondary access drive to the east tract boundary. However, if
Alipaz Street is extended across the railroad tracks prior to or
at the same time as the Junipero Serra Road construction, then
the developer shall extend Junipero Serra to the tract's west
boundary to connect to Alipaz. In any case, improvements
shall also include an off-road bikeway along the tract frontage
on both sides of the street east of Camino Capistrano and on
the south side of the street only west of Camino Capistrano.
The cost of the Junipero Serra improvements may be subject to
a reimbursement agreement based on the estimated traffic
generation of affected projects.
The tentative map shall be amended to show the street sections as
specified above. Street improvement plans shall also conform to the
street sections specified above.
11. Junipero Serra Median - The subdivider shall construct a raised
median on Junipero Serra Road in accordance with the following
phasing:

a. During initial development of any portion of the subdivision:
Construction of the Junipero Serra median east of Camino
Capistrano, from Camino Capistrano up to the existing service
station driveways;
PLUS,
b. 1. Upon connection of Junipero Serra to Alipaz: Full
construction of the median both east and west of Camino
Capistrano; or,
2. Upon initial development of the CC (Community
Commercial) site: Construction of the full median from
Camino Capistrano to the southbound 1-5 freeway ramps;
or,
3. Upon interim traffic need as determined by the Director
of Public Works: Construction of all or any part of the
Junipero Serra median.
12. Camino Ca istrano Median - The Camino Capistrano median opposite
Lot 3, the CC Community Commercial) site, shall be designed so
that left or right turns into the CC site are permitted, but only right
turns out. Design and location of the left -turn pocket shall be
approved by the City Engineer prior to approval of a final map.
13. Offsite Improvement Participation - The subdivider shall participate
in and contribute to the following improvements not within the
subdivision:
a. Traffic signal at Junipero Serra Road and Rancho Viejo Road.
b. Extension of Alipaz Street from north of Del Obispo Street to
Junipero Serra road.
C. Improvement of Junipero Serra Road from I-5 to Rancho Viejo
Road.
d. Rancho Viejo Road bridge widening over Trabuco Creek.
e. Non -potable water system in conjunction with the Capistrano
Valley Water District.
The subdivider's level of financial participation in the preceding —
improvements shall be determined by the City Engineer in
conjunction with traffic generation data from the project
environmental impact report and from other City sources.
14. Traffic Signals - The subdivider shall design and construct traffic
signals at the intersections of Junipero Serra Road and realigned
Camino Capistrano, the main project entry and realigned Camino
Capistrano, and Oso Road and realigned Camino Capistrano. Traffic
signal plans shall be approved by the City Engineer prior to
construction.

15. Dedications - The following dedications and offers to dedicate shall
be made on the final map:
a. A continuous offer to dedicate all land 57 feet south of the new
centerline of Junipero Serra Road from west of realigned
Camino Capistrano to the west tract boundary for road
purposes, including necessary slope easements, for the future
connection of Junipero Serra to Alipaz Street.
b. Dedication of diagonal corner cutoffs at the corners of public
streets and signalized intersections.
C. Dedication of necessary easements for emergency and public
security ingress and egress purposes.
16. Vehicular Access Rights - On the final map, vehicular access rights
to Camino Capistrano and Junipero Serra Road shall be released and
relinquished to the City except at street intersections and approved
driveway locations.
17. Street Improvement Plans - Prior to issuance of a grading permit for
the first development phase within the tract, street improvement
plans, prepared by a traffic and civil engineer, shall be submitted
showing striping, signing, storm drain, sewer, and water
improvements for Junipero Serra Road from 300 feet west of
existing Camino Capistrano to 300 feet east of the east tract
boundary, for Camino Capistrano from Calle Chueca to existing
Camino Capistrano near Trabuco Creek, and for Oso Road from
Avenida de la Vista to realigned Camino Capistrano. Said plans shalt
be approved by the City Engineer prior to street construction.
18. Cross Gutters - Cross gutters shall be prohibited unless approved by
the City Engineer.
19. Main Entry Design - The main entry drive shall incorporate a full
curb return design on both sides of Camino Capistrano and not a
"dustpan" -type driveway.
