Resolution Number 89-4-4-2RESOLUTION NO. 89-4-4-2 ESTABLISHING DEPOSIT SYSTEM FOR PROCESSING OF DEVELOPMENT PLANS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING CITY RESOLUTION NO. 83-7-5-1 TO AMEND DEVELOPMENT FEES FOR THE PROCESSING OF DEVELOPMENT PLANS WHEREAS, the City Council adopted Resolution No. 83-7-5-1 which established fees for the processing of development plans, divisions of land, administrative matters, and other related land use issues; and, WHEREAS, the City has incurred higher costs in the processing of said development applications within the last 12 months; and, WHEREAS, the City Manager's Office has developed data indicating that an increase in fees for the processing of development applications is in order. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano that Resolution No. 83-7-5-1 is hereby amended with respect to fees for the processing of certain development applications as follows: SECTION 1. Establishment of Hourly Fee and Deposit System. There is hereby created an hourly fee of $46.10 per hour to be charged developers processing certain development applications as set forth below in Section 2 of this Resolution. In addition, a deposit system is created whereby a developer shall post a deposit in the amounts set forth in Section 2 with the City prior to the City initiating any development review for said development applications. As City incurs manhour costs, appropriate deductions shall be made from the deposit fund for each application. SECTION 2. Deposit Fees and Covered Land Use Applications. The following land use applications shall be subject to the hourly fee and deposit system set forth in Section 1 of this Resolution: 1. Tentative Tract Maps No growth management Growth management $2,900.00 plus $360.00 per unit or lot $2,900.00 plus $75.00 per unit or lot 2. Tentative Parcel Maps Residential $2,900.00 per application Commercial -I- $725.00 per unit or lot (minimum of $2,000.00) 037 Reversions to acreage 3. Change of District Boundaries First 5 acres Next 20 acres Over 25 acres 4. Conditional Use Permits Residential Commercial or Industrial Satellite Dish Antennas (commercial) 5. Variances variances 6. Site Plans Residential Commercial or Industrial Modifications i 7. General Plan Amendments -2- $360.00 $725.00 per acre $435.00 per acre $75.00 per acre $725.00 $1,450.00 $725.00 $220.00 $1,450.00 plus $365.00 per unit or lot for the first 25 units; $75.00 for each additional unit or lot $2,150.00 per acre for the first 5 acres; $22.00 per acre for 5 plus acres $365.00 $1,450.00 per acre for the first 10 acres; $725.00 per acre for the next 15 acres; $75.00 per acre for the next 75 acres; $35.00 per acre for over 100 acres ''1 038 SECTION 3. Exhaustion of Deposits. In the event that a deposit is exhausted prior to completion of plan review, the Director of Community Planning and Development is hereby authorized to require the developer to replenish the deposit fund in an amount he deems reasonably necessary to cover the remainder of costs to be incurred in completing the development review process.
