APPROVING CONDITIONAL USE PERMIT 88-12
' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, UPHOLDING APPEAL AND
APPROVING CONDITIONAL USE PERMIT 88-12 (COMMUNITY
CHRISTIAN CHURCH) FOR JOINT PARKING FACILITIES
WHEREAS, the applicant, Community Christian Church, 31612 El Camino
Real, San Juan Capistrano, California, has submitted an application for a Conditional Use
Permit to establish a joint parking facility for the church located at 31612 El Camino
Real in the 1P (Public and Institutional) District; and,
WHEREAS, the City's Environmental Review board has determined that the
proposed project will not have a significant effect on the environment, has accordingly
issued a negative declaration for the project, and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the City's Planning Commission denied the Conditional Use Permit
request for joint parking on January 19, 1989; and,
WHEREAS, the appellant, Community Christian Church, 31612 EI Camino
Real, San Juan Capistrano, California, has submitted an appeal of the Planning
Commission's action of denial; and,
WHEREAS, a public hearing has been duly noticed and held to receive public
testimony on the application; and,
WHEREAS, the City Council does hereby find and determine as follows:
1. Amount of Credit - The Capistrano Unified School District's letter dated
October 10, 1988, offering annual joint parking privileges, encompasses
the use of three parking areas on the San Juan Elementary School and
Buchheim field sites. the three areas will provide a total of 145 spaces
which exceeds the 129 parking spaces required by the Municipal Code.
2. Location - The parking facilities designated for joint use are contiguous
to all of the structures and uses served.
3. Absence of Conflicts - No substantial conflicts exist in the principle
hours or periods of peak demands of the structures and uses using the
joint parking facilities.
NOW, THEREFORE, BE IT RESOLVED, that based upon the preceding findings,
the City Council of the City of San Juan Capistrano does hereby grant Conditional Use
Permit 88-12, by reversing the Planning Commission denial, subject to the following
condition:

Prior to the issuance of a building permit, the applicant shall enter into a
parking agreement with the Redevelopment Agency of the City of San
Juan Capistrano, which Agreement shall make appropriate arrangements
for permanent parking for the church expansion. No building permit shall
be issued to the applicant, nor shall construction activity of any kind be
initiated by the applicant, unless and until said Agreement is executed
and approved by the Redevelopment Agency of the City of San Juan
Capistrano.
