Resolution Number 90-5-15-4 269 RESOLUTION NO. 90-S-15-4 VACATING EQUESTRIAN EASEMENT, TRACT 9795 (LOVE TRACT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ORDERING THE VACATION OF EQUESTRIAN EASEMENT AREA, TRACT 9795 (LOVE TRACT) WHEREAS, the City Council of the City of San Juan Capistrano adopted Resolution No. 90-4-17-9, initiating proceedings to vacate an equestrian easement area as set forth in Exhibits A and B, attached and incorporated herein by reference, pursuant to Streets and Highways Code Sections 8302 et. seq.; and, WHEREAS, pursuant to said resolution, the City Council conducted a public hearing on May 15, 1990; and, WHEREAS, the City Council has heard evidence concerning the proposed vacation of said easement area; and, WHEREAS, this matter is exempt from California Environmental Quality Act review. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano as follows: SECTION 1. The City Council hereby finds from all evidence submitted, that the equestrian easement area described in Exhibits A and B is unnecessary for present or prospective public use. Said finding is based upon and incorporates by reference the staff report findings dated May 15, 1990. SECTION 2. The City Council hereby orders that the equestrian and hiking easement area defined in Exhibit A be and hereby is vacated. SECTION 3. The City Clerk shall cause a certified copy of this resolution of vacation to be recorded in the office of the Recorder of the County of Orange. No fees shall be _1_ zlio charged for said recording pursuant to Streets and Highways Code Section 8325. Upon such recordation, the vacation shall be complete pursuant to Streets and Highways Code Section 8325. PASSED, APPROVED, AND ADOPTED this 15th day of May , 1990. f ARY L. All easements are more particularly shown on Sheet 2 of the Tract Map for Tract 9795, recorded with the Orange County Recorder in Book 415, Pages 21 & 22. i These easements are delineated on Exhibit B, "Calle Roberto Feeder Trail System", attached herein.
