A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, TO SUPPORT DESIGNATION
OF THE WASTE MANAGEMENT COMMISSION AS THE COUNTY-
WIDE TASK FORCE UNDER AS 939, THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT ACT OF 1989
WHEREAS, the California Integrated Waste Management Act of 1989, AS 939,
makes a number of changes in solid waste management planning at the City and County
level; and,
WHEREAS, AS 939 requires preparation of a County -Wide Integrated Waste
Management Plan incorporating many provisions and procedures of the traditional County
Solid Waste Management Plan; and,
WHEREAS, AS 939, Part 11, Chapter 2, required each County to convene a
County -Wide Task Force to assist in the development of the County -Wide Integrated
Waste Management Plan, individual City and County Source Reduction Recycling
Elements, and County -Wide Siting Element; and,
WHEREAS, the County -Wide Task Force is charged with several tasks to
ensure a coordinated and cost-effective regional integrated waste management program;
and,
WHEREAS, membership of the Task Force is to be determined by the Board of
Supervisors and a majority of the cities having a majority of the population, and may
include representatives of the solid waste industry, environmental organizations, general
public, special districts, and affected governmental agencies; and,
WHEREAS, the existing Orange County Waste Management Commission serves
in an advisory capacity on matters dealing with transfer stations, landfill sites, resource
recovery sites, fees and charges, system financing, and the County Solid Waste
Management Plan; and,
WHEREAS, membership on the Waste Management Commission is comprised of
County and City elected and appointed officials, waste industry representatives, general
public, and affected organizations; and,
WHEREAS, several objectives would be accomplished by having the Waste
Management Commission serve as the County -Wide Task Force as specified by AB 939
including: ensure continued representation by cities on County -Wide solid waste matters;
prevent proliferation and fragmentation of committees dealing with waste management
issues; facilitate consistency among the plans and elements developed by cities and the
County in response to AS 939; and, aid in efforts to integrate County -Wide waste
management planning in Orange County.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does support designation of the Waste Management Commission as
the County -Wide Task Force required by AB 939, the California Integrated Waste
Management Act of 1989.
