A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, UPHOLDING APPEAL OF
CORAL PROPERTIES RELATING TO PROPOSED BARN MULTI -USE
STRUCTURE AS AN ACCESSORY USE TO THE AGRICULTURE
ZONE (CORAL PROPERTIES/MAURER)
WHEREAS, Coral Properties submitted a formal application for hillside
management (HM) zoning approval to construct an approximate 15,000 -square -foot
multi-purpose barn structure on a 42 -acre parcel; and,
WHEREAS, the Planning Director, pursuant to Title 9, Chapters 2 and 3 of the
Code, made an administrative determination on November 14, 1990, that the proposed
barn multi -use structure was not a valid accessory use under the Agricultural District
zoning for this property; and,
WHEREAS, Coral Properties filed a timely appeal of said administrative
determination; and,
WHEREAS, the appeal came on for hearing before the City Council on
January 15, 1991; and,
WHEREAS, the City Council has fully considered oral testimony, and the
written arguments of the appellant and the staff.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San
Juan Capistrano, that:
After having considered all oral testimony and written arguments of
staff and appellant, the City Council does hereby affirm the appeal and
conclude that sufficient facts have been presented by the appellant to
indicate that the proposed multi -use structure is a valid accessory use
under Municipal Code Section 9-3.401.
2. During the appeal hearing, the City Council considered oral testimony
from the appellant describing the scope of the date palm tree farm
operation which, according to the appellant, will entail the storage of
considerable equipment to service the trees. Based on the appellant's
full explanation, the Council finds that adequate information has been
provided to show that the structure is necessary and incidental to the
agricultural uses put forward for this property. This finding is not
intended to mean that Coral is limited to a date farm operation, nor that
Coral's accessory structure is accessory to date farm operations.

3. Other issues such as the location of the structure and its mass, scale,
grading, architectural features, and landscaping will be subject to later
discretionary review, as might be required by the Municipal Code.
