Resolution Number 91-2-5-1379 RESOLUTION NO. 91-2-5-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, RECOMMENDING THAT THE TRANSPORTATION CORRIDOR AGENCY EXECUTIVE BOARD NOT CERTIFY THE DRAFT ENVIRONMENTAL IMPACT REPORT WHEREAS, the Transportation Corridor Agency ("Agency") circulated a Draft Environmental Impact Report/Study ("DEIR/DEIS") for the proposed San Joaquin Hills Transportation Corridor ("SJHTC") for review and comment by effected agencies, cities, and persons; and, WHEREAS, the City of San Juan Capistrano reviewed the DEIR/DEIS and forwarded comments to the Agency by letter dated November 19, 1990; and, WHEREAS, the Transportation Corridor Agency_ ("Agency") circulated a "Response to Comments" on the DEIR/DEIS on February 4, 1991 for review and comment by effected agencies, cities, and persons; and, WHEREAS, the City has completed a preliminary review of the Agency's "Response to Comments" to determine their adequacy in relationship to those issues previously cited by the City. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: 1. The Draft Environmental impact Report for the Proposed San Joaquin Hills Transportation Corridor (SJHTC) is inadequate; and, 2. The Transportation Corridor Agency's "Response to Comments" are inadequate based on insufficient disclosure or mitigation of potential environmental impacts with regard to: - Traffic and circulation - Noise - Air Quality - Residential relocation - Land use compatibility - Construction impacts 3. The United States Environmental Protection Agency ("EPA") has advised the Agency that the Draft Environmental Impact Report does not fully comply with the provisions of the National Environmental Policy Act. -1- BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby recommend that the Transportation Corridor Agency Executive Board not certify the Draft Environmental Impact Report for the Proposed San Joaquin Hills Transportation Corridor at this time.
