Resolution Number 90-11-20-4241) RESOLUTION NO. 90-11-20-4 FEE SCHEDULE - INSPECTION. DUPLICATION, TAPE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PROCEDURES AND FEE SCHEDULE FOR INSPECTION, DUPLICATION AND PURCHASE OF VARIOUS CITY DOCUMENTS AND REPEALING RESOLUTIONS NOS. 76-8-18-4, 77-1-5-4, AND 87-9-29-6 WHEREAS, the City receives numerous requests from the general public to hear, record, or transcribe tapes of City Council, Commission, and/or Board meeting proceedings; and, WHEREAS, it is necessary and advisable that a City staff member be present when a member of the public listens to or transcribes such tape recording; and, WHEREAS, such audio recordings of Council, Commission, and/or Board meetings may not be removed from the City offices; and, WHEREAS, the City also receives requests from the general public for inspection, duplication and purchase various City documents; and, WHEREAS, the cost to the City for providing such documents is considerable and should be reimbursed to the City. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano that the following procedural rules and regulations are adopted in accordance with the California Public Records Act, Chapter 3.5, Division 7, Title 1, of the Government Code of the State of California, Paragraph 6250, et seq., with regard to making records available for inspection by the public: SECTION 1. Form of Request. Requests for inspection of any identifiable public record, copies of same, or certified excerpts therefrom shall be made in writing on forms provided by the City department responsible for the keeping of such record, and shall contain the following information: 1. Name and address of person, corporation, partnership, form or association making such request. 2. Identification of record being requested. 3. Amount of fee or deposit accompanying request per schedule established by the City Council and set forth in Section 4 herein. 4. Date of request and date and time information is required. -1- 250 4 SECTION 2. Time Periods for Requests. Requests are to be made during regular business hours, and a reasonable period of time to be determined by the department head for handling such requests shall be allowed. -� SECTION 3. Records Exempt from Inspection. Certain records enumerated in Section 6254 of the Government Code shall be exempt from inspection by the public; in addition, business license applications and any other records for which it can be demonstrated by the officer who has custody that the public interest served by not making such record public clearly outweighs the public interest served by disclosure of the record. The City Manager shall review and approve or reverse such denials. SECTION 4. Fee Schedule The schedule of fees and/or deposits is hereby established as follows: Copies of records (8;x1 l") $0.20 per page copied public (provided upon payment) Fair Political Practices Commission Filings $0.10 per page Fax copies of public records $10.00 for first 5 pages (provided upon payment) $1.00 each page thereafter City Council, Agency or Commission Agendas $20.00 per year (half price 7/1 through 12/31) City Council, Agency or Commission Minutes $60.00 per year (half price 7/1 through 12/31) Municipal Code Volume and Binder $195.00 Municipal Code Supplement Service $35.00 per year Title 9, Land Use (includes first year supplement service) $35.00 Title 9, Supplement Service $8.00 per year Title 8, Building Regulations (includes first year supplement service) $12.00 Title 8, Supplement Service $5.00 per year General Plan Text $15.00 Equestrian Trail Maps $2.00 Large Zoning or General Plan Maps $5.00 -2- Small Zoning or General Plan Maps Architectural Design Guidelines and Hillside Development Guidelines Fiscal Budget Postage Charges Listening to, recording from, duplicating, making transcripts of City Council, Commission and/or Board meeting tapes Special reports requiring research of records, analysis, compilation, calculation or summarization for private benefit 251 $3.00 $6.00 $25.00 At Postage Cost At cost (minimum $5.00 charge/blank tapes for duplication to be provided by person requesting service) At cost At cost is defined as employee's hourly rate plus 25% for fringe benefits and 15% administrative overhead (minimum charge and/or deposit $5.00) SECTION 5. Waiver of Fees. The above fees may be waived at the discretion of the Department Head concerned when it is clear that the general public and/or the City will benefit by providing the service at no cost. (a) Examples of the types of service for which the above fees may be waived are as follows: (1) Requests from City Officials, Board Members, etc. (2) Requests from other public agencies, especially in cases of cooperative exchange of information. (3) Requests from non-profit or charitable groups such as the Chamber of Commerce, Boy Scouts, etc. (4) Requests from individuals or firms directly concerned with pending actions of the City Council which require their attendance at a Public Hearing, or when legal notice is required. (b) Decisions on questionable items shall be made by the City Manager. -3- 252 . SECTION 6. Appeals. Appeals to the City Council may be filed with the City Clerk by those who desire to protest these charges or request waivers. SECTION 7. Repealer. Resolutions Nos. 76-8-18-4, No. 77-1-5-4, and No. 87-9-29-6, are hereby repealed. PASSED, APPROVED, AND ADOPTED this 20th day of November , 1990.
