Resolution Number 90-11-6-1221 RESOLUTION NO. 90-11-6-1 AMENDING DEVELOPMENT FEES AND DEPOSITS FOR PROCESSING DEVELOPMENT APPLICATIONS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING DEVELOPMENT FEES AND DEPOSITS FOR THE PROCESSING OF PLANNING DEVELOPMENT APPLICATIONS AND REPEALING RESOLUTION NOS. 83-7-5-1, 89-4-4-2, AND 90-4-3-1 WHEREAS, the City Council has adopted Resolution Nos. 83-7-5-1, 89-4-4-2, and 90-4-3-1, which establish fees and deposits for the processing of planning and engineering development plans, divisions of land, administrative matters and other related land issues; and, WHEREAS, the City has incurred higher costs in the processing of said planning development applications within the last several years; and, WHEREAS, the City Manager's office has now developed revised cost figures associated with the processing of planning development applications. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano as follows: SECTION 1. Establishment of Processing Fees and Deposits The processing fees and deposits set forth in Exhibit A, attached and incorporated by reference, are hereby adopted with respect to processing of development applications within the Department of Planning. SECTION 2. Re ealer All planning development application fees and deposits previously established by Resolution Nos. 83-7-5-1, 89-4-4-2, and 90-4-3-1 are hereby repealed. The initial deposits are intended to provide funding for processing of an application. If the deposited funds are depleted during the processing of the application, additional funds will be required by the City. If the requested funds are not received, processing of the development application will be stopped. Any unused funds at project completion will be reimbursed to the applicant. The following City staff positions shall charge actual hours expended on a project to the developer deposit account: Land Use Division Land Use Manager Senior Planner Associate Planner Assistant Planner Zoning Assistant Planning Intern Community Services Community Services Supervisor Building and Safety Building and Safety Manager Permit Services Supervisor Building Assistant Public Lands do Facilities Director of Public Lands be Facilities Engineering City Engineer Senior Civil Engineer Associate Civil Engineer Engineering Assistant Senior Engineering Aide Engineering Aide 2. Hourly rates of City staff shall be determined from the current salary schedule adopted by City Council resolution each fiscal year. 3. Overhead costs shall be added to the staff's hourly rate. Overhead costs shall be calculated and published biannually (January 15 and July 15) by the Director of Administrative Services in accordance with the Office of Management and Budget Circular A-87 (Cost Principles for State and Local Governments). Consultant Rates 1. Consultants actual costs shall be charged against the developer deposit account. Each consultant is employed by a master contract. Purchase orders are issued for each project. The amount of the purchase order and the hourly consultant rate is determined by the Land Use Manager on a project -by -project basis. 2. A general City-wide overhead cost shall be added to cover the administrative costs for processing consultants contracts and invoices. 3. Overhead costs shall be calculated and published biannually (January 15 and July 15) by the Director of Administrative Services in accordance with the Office of Management and Budget Circular A-87 (Cost Principles for State and Local Governments).
