Resolution Number 90-8-21-4I 4_.3 RESOLUTION NO. 90-8-21-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 90-05 FOR THE CAPISTRANO BUSINESS PLAZA (DELGAR PARTNERS, INC.) WHEREAS, the applicant, Capistrano Business Plaza Associates, 28202 Cabot Road, Suite 210, Laguna Niguel, California, has submitted a request to build restricted offices on a site previously approved for a private health club within the Public and Institutional (PI) land use designation of the general plan; and, WHEREAS, on October 3, 1989, the City Council initiated this general plan amendment and rezone for the subject property and requested staff to analyze the following land use changes: a. Redesignation of the recreation element of the project site to office use. b. Reconfiguration of the presently -designated recreation element of the site to provide for some open space uses in conjunction with office uses. C. Installation of an athletic par course on the property; and, WHEREAS, the City's Planning Commission has forwarded General Plan Amendment 90-05 to the City Council recommending approval of the project subject to the deletion of the proposed recreational par course and the addition of landscaping and three picnic/rest areas, as stated in Condition No. 9 of Planning Commission Resolution 90-7-24-3; and, WHEREAS, a public hearing has been duly advertised in the Capistrano Valley News and held to receive public testimony on the project. Property owners within 300 feet of the project boundary have been sent notice of the project pursuant to the requirements of state law; and, WHEREAS, the City Council finds and determines as follows: 1. The proposed project, as conditioned, is consistent with the 5.0 Public and Institutional designation on the General Plan Map and with the goals, policies, and objectives of the General Plan; and, 2. The proposed project, as conditioned, is consistent with the Planned Development (PD) District and Specific Development Plan 81-2 zoning for the property, and otherwise conforms to all applicable requirements of Title 9 (Land Use) of the City's Municipal Code; and, -1- NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano as follows: The Negative Declaration for this project is adopted as consistent with California Environmental Quality Act and state and city guidelines. .r► 2. The General Plan tax heretofore adopted shall be changed to delete references to private recreation facilities. The recommended amendment is designated as General Plan Amendment 90-05 and is more specifically depicted as "Exhibit A" attached hereto. Some future schools are designated on the map. in addition to these uses, office complexes may be considered compatible with the Publicllnstitutional designation. In April 1982, the City approved an amendment to the Ceneral Plan providing for the designation of 14.21 acres as Public Institutional land use for property located on the southeast comer of Rancho Viejo Road and Mission Hills Drive. This designation is restricted to providing for the location of a medical facility, which is to belmited to medical offices, medical support facilities, surgery centernccessory pharmacy.
