Resolution Number 90-8-21-3RESOLUTION NO. 90-8-21-3 APPROVING TENTATIVE PARCEL MAP 90-156 (SERRA PLAZA LTD.) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY .APPROVING TENTATIVE PARCEL MAP 90-156 (SERRA PLAZA LTD.) WHEREAS, the applicant, Serra Plaza Ltd., Clifford D. Cooper, 1000 South Bay Front, Newport Beach, California 92662, has submitted Tentative Parcel Map 90- 156, proposing to subdivide approximately 4.5 acres of land into 4 lots, generally located at the southeast corner of Del Obispo Street and Paseo Adelanto; and, WHEREAS, the City's Environmental Review Board has determined that the proposed project, in accordance with the California Environmental Quality Act, is categorically exempt (Class 15); and, WHEREAS, the City's Planning Commission has forwarded the project to the City Council recommending approval; and, WHEREAS, a public hearing has been duly advertised and held to review and receive public testimony on the application; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1. The proposed project, as conditioned, and its design and improvements are consistent with the Quasi -Industrial designation on the General Plan map. 2. The proposed project, as conditioned, conforms to all applicable requirements of Title 9 of the City's Municipal Code (Land Use). 3. The project site is physically suitable for the type of proposed development. 4. The design and improvements of the proposed project will not cause substantial em ironmental damage; nor will said design or improvements avoidably injure wildlife or their habitat. 5. The design or improvements of the proposed project will not cause serious public health problems. 6. The design or improvements of the proposed project will not conflict with easements acquired by the public at large for access through or use of property within the proposed project. BE 138 4 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve Tentative Parcel Map 90-156 (Serra Plaza Ltd.), subject to the following conditions: Prior to final map approval, the subdivider shall complete the following: �+ a. Any off-site grading will require written permission of the property owner affected. Said written notice shall be notarized and filed l with the City Engineer. b. Any connections to City storm drains from private on-site drains must be approved by the City Engineer. A recorded instrument is required for private storm drain connections to City storm drain facilities and must be filed with the City Engineer. C. Participate in the railroad preemption and the Del Obispo pedestrian bridge fee programs, the pro rata share amount to be determined by the City Engineer. d. Grading, sewer, water, storm drain, street striping and street improvement plans shall be approved by the City Engineer. The street improvement plan shall show 1) a street -type entry on Paseo Adelanto, and 2) right -turn only signs at the entrance and exit on Del Obispo Street. e. A soil report/geotechnical feasibility study shall be approved by the City Engineer and Building Official. I. An agreement shall be executed with the City to allow public use of the pedestrian walkway within private property along the east side of Paseo Adelanto. g. A subdivision improvement agreement, with a surety bond, shall be executed to 1) construct and widen the entrance right turn on Del Obispo Street; and 2) construct and widen Paseo Adelanto to 38 feet curb to curb including a left -turn pocket to the satisfaction of the Fire Department and City Engineer. h. Provide documentation that a reciprocal access agreement has been secured from Sycamore Canyon (property to the south). i. CC&R's shall be approved by the Director of Community Planning and Development to establish a Property Management Association to provide common maintenance of landscaping, circulation and access of parking areas upon ultimate development of Parcels 1, 2 and 3. Provide information to the Fire Department on whether the fire hydrant system is public or private. If private, an agreement between the Fire Department and subdivider shali be executed which provides for service and maintenance of the system. -2-
