RESOLUTION NO. 90-8-21-2

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, ORDERING VACATION OF
SHAMROCK LANE, GLENARIFF LANE .AND CONNEMARA DRIVE
(FROM AVENIDA PESCADOR TO GLENARIFF LANE) WITHIN A
PORTION OF TRACT 9784
WHEREAS, on the 7th day of August, 1990 the City Council passed a resolution
declaring its intention to vacate Shamrock Lane, Glenariff Lane, and Connemara Drive
(from Avenida Pescador to Glenariff Lane) within a portion of Tract No. 9784; and,
WHEREAS, the streets to be vacated are as shown on Exhibit "A", attached
hereto and by this reference made a part hereof; and,
WHEREAS, notice of a hearing to hear objections to said vacation was duly
published and posted in accordance with Section 8322 and 8323 of the California Streets
and Highways Code; and,
WHEREAS, a hearing thereon was duly held in the Chamber of the City
Council on August 21, 1990; and,
WHEREAS, the City Council has heard testimony and received evidence upon
the aforesaid vacation, and finds that there were no objections voiced or received to the
proposed vacation.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano, does hereby vacate and close to public use Shamrock Lane,
Glenariff Lane, and Connemara Drive (from Avenida Pescador to Glenariff Lane), more
particularly shown on the map on file in the City Clerk's Department, a copy of which is
attached hereto, excepting therefrom a perpetual non-exclusive easement and right-of-
way for utility facilities and services including specifically, but not by way of limitation,
the right to lay, construct, reconstruct, remove and replace, renew, inspect, maintain,
repair, improve, relocate and otherwise use said utilities together with incidental
appurtenances, connections and structures and other necessary easements for ingress and
egress and public utility purposes, and elects by this Resolution to proceed under the
provisions of the Streets and Highways Code, Division 9, Part 3, Section 8320, et seq.
BE IT FURTHER RESOLVED that the City Council finds that the above -
stated streets are unnecessary for present or prospective public use.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to cause a certified copy of this Resolution to be recorded in the Office of the
County Recorder for the County of Orange, State of California.
BE IT FURTHER RESOVLED that this Resolution shall not take effect for 30
days following adoption, or September 20, 1990.

k. A Site Development Review application, which shall include
schematic site plan, grading plan, landscape plan (including all
existing trees and the meandering walkway) and conceptual building
envelope shall be approved by the Planning Commission.
2. Subdivider sha!! Include the following information on the final map:
a. Dedication of Paseo Adelanto to its ultimate width of 26 feet from
centerline.
b. Dedication of reciprocal easements of ingress and egress for all
parcels.
C. Dedication of a 10 -foot diagonal corner cut-off at the southeast
corner of Del Obispo Street and Paseo Adelanto.
d. Dedication of easements to the City for emergency and public
security ingress and egress purposes.
3. Expiration of Approval - Per Section 9-2.305 of the Municipal Code, this
tentative map approval shall expire on August 21, 1992, i.e., two years
from the City Council approval date. If the Final Map has not been
recorded by that date, the development approval shall become null and
void.
