Resolution Number 90-7-17-8o75 r"" RESOLUTION NO. 90-7-17-8 REAFFIRMING PLANNING COMMISSION ACTION - SIGN PROGRAM (JOHNSON/YU) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, REAFFIRMING THE PLANNING COMMISSION ACTION ON MAY 22, 1990, REGARDING CONDITIONS NOS. 2a, AND 2f AND MODIFYING CONDITION NO. 2c OF PLANNING COMMISSION RESOLUTION NO. 90-5-22-2 (SIGN PROGRAM, JOHNSON/YU - PASEO MERCADO) WHEREAS, the applicants, Mr. Chuck Johnson, 32136 Miguelito Road, San Juan Capistrano, California, Ms. Shirley Yu, 1 Summit Road, Irvine, California, and Mr. Brent Ogden, and 4040 MacArthur Boulevard, Suite 205, Newport Beach, California, have submitted an appeal to the Planning Commission conditional approval of the sign program for a 5.11 -acre commercial center located at the terminus of Paseo Mercado de Capistrano in the CG (General Commercial) District; and, WHEREAS, the City's Environmental Review Board has reviewed the overall development and has determined that this project will not result in a significant impact on the environment and has accordingly issued a Negative Declaration and carried out all applicable provisions of the California Environmental Quality Act; and, WHEREAS, the Planning Commission in accordance with Planning Commission Resolution No. 89-9-12-1, Condition No. 7, reviewed a sign program and approved the program, subject to conditions which require external back -lit illumination and 18 -inch -high channel letter signs at its meeting of May 22, 1990; and, WHEREAS, on June 11, 1990, the applicant appealed the decision of the Planning Commission to the City Council; and, WHEREAS, on July 17, 1990, the City Council considered the applicant's appeal and testimony on the request and reaffirms the Planning Commission's action on May 22, 1990, regarding Condition Nos. 2a, 2f, and modified Condition No. 2f of Planning Commission Resolution No. 90-5-22-2. NOW, THEREFORE, BE IT RESOLVED, that based upon the preceding findings, the City Council of the City of San Juan Capistrano does hereby reaffirm the Planning Commission's action on May 22, 1990, regarding Condition Nos. 2a and 2f and modifies Condition No. 2c of Planning Commission Resolution No. 90-5-22-2 to read as follows: 1. The applicant shall have the option of illuminating the larger tenant, type B, signs by one of the following methods: Alternative A, a reverse channel letter sign with a backlit light source or Alternative B, a reverse channel letter sign with an externally -mounted fixture with the light directed towards the sign face. If Alternative A, no further review is required. If Alternative B, the Planning Commission shall reivew and approve the following: a. Type of light fixture, including sizes and colors. The light fixture shall be shielded from view. -1- 076 b. Location of light fixtures. C. Type of light source. Incandescent or a similar soft lighting shall be used. Halogen lights or similar types of lighting which the Planning Commission determines will produce a harsh glare shall be prohibit.
