RESOLUTION NO. 91-5-21-6

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING
THE FINAL WORKING DRAWINGS FOR THE HISTORIC DEPICTION
PROGRAM FOR ARCHITECTURAL CONTROL 90-9 (EGAN
HOUSE/DiMAIO)
WHEREAS, the applicant, Ms. Sue DiMaio, 25802 La Serra Street, Laguna
Hills, California, has submitted an application for approval of the final working drawings
for the Historic Depiction Program for Architectural Control 90-9 (Galleria Capistrano);
and,
WHEREAS, the City's Environmental Review Board has determined that the
proposed project will not have a significant effect on the environment, has accordingly
issued a negative declaration for the project, and has otherwise carried out all
requirements of the California Environmental Quality Act; and,
WHEREAS, the City's Planning Commission certified the Negative Declaration
and approve the Site Development Review application and conceptual Historic Depiction
Program for Architectural Control 90-9 on October 23, 1990, subject to conditions; and,
WHEREAS, the City's Cultural Heritage Commission reviewed the
Architectural Design Review application and conceptual Historic Depiction Program on
January 7, 1991, and forwarded it to the Design Review Commission recommending
approval, subject to certain condition; and,
WHEREAS, the City's Design Review Commission reviewed and conditionally
approved the Architectural Control application and conceptual Historic Depiction
Program for Architectural Control 90-9 on January 16, 1991; in addition, the City's
Design Review Commission reviewed and conditionally approved the landscape plan for
Architectural Control 90-9 on March 20, 1991; and,
WHEREAS, the City Council hereby finds and determines as follows:
1. The Historic Depiction Program integrates San Juan Capistrano's history
into the development of the City by utilizing a plaque which incorporates
a narrative of the life and contributions of Judge Richard Egan who
resided in the house and was a major contributor to the community.
2. The Historic Depiction Program incorporates representations of the
downtown area's cultural heritage into the everyday life of the
community by utilizing a plaque and display case which will be highly
visible and greatly accessible to the general public.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby approve the final working drawings for the Historic
Depiction Program for Architectural Control 90-9, subject to the following conditions

Certificate of Occupancy - the Certificate of Occupancy for the
adaptive reuse of the Judge Egan house shall be issued only upon
completion of the installation of the Historic Depiction Program
including the plaque on the exterior of the house and the artifacts to be
located on the interior of the building.
