Resolution Number 91-4-16-2m RESOLUTION NO. 91-4-16-2 EXCESS STREET RIGHT-OF-WAY AND SLOPE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING ITS INTENT TO VACATE AN USUSED PORTION OF AN IRREVOCABLE OFFER FOR RIGHT-OF-WAY FOR DEL OBISPO STREET AND AN ADJACENT SLOPE EASEMENT WITHIN A PROPERTY LOCATED AT 32202 DEL OBISPO (COMMUNITY PRESBYTERIAN CHURCH) WHEREAS, on the 16th day of April, 1991, the City of San Juan Capistrano found and determined that the herein referenced irrevocable offer and easement can be properly vacated; and, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does as follows: SECTION 1. That the City Council of the City of San Juan Capistrano does hereby declare its intention to vacate an unused portion of the irrevocable offer for right-of-way for Del Obispo Street and the adjacent slope easement located at 32202 Del Obispo Street, more particularly shown on the map and legal description attached hereto as Exhibit "A" and Exhibit "B." SECTION 2. That a public hearing shall be held on the 21st day of May, 1991, at 7:00 p.m., in the Council Chamber of the City of San Juan Capistrano, 32400 Paseo Adelanto, at which time all persons interested in or objecting to these proceedings shall be heard. SECTION 3. That this resolution shall be posted in the duly designated posting places within the City of San Juan Capistrano not less than fifteen (15) days prior to the aforesaid hearing date and published for at least two successive weeks prior to the hearing. SECTION 4. That at least three (3) notices of the proposed easement vacation shall be placed not more than 300 feet apart and posted conspicuously along the aforesaid easement at least fifteen (15) days prior to the public hearing.
