REVIEW COMMISSION DENIAL OF
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, UPHOLDING THE DESIGN
REVIEW COMMISSION DENIAL OF THE MODIFICATION TO THE
APPROVED SIGN PROGRAM FOR ARCHITECTURAL CONTROL
88-9 (PASEO CAPISTRANO CENTER - VOLUME SHOE
COR PORATION/PAY LESS SHOE SOURCE)
WHEREAS, the applicant, Volume Shoe Corporation, 625 The City Drive, Suite
240, Orange, CA 92668, has submitted an appeal of the Design Review Commission denial
of a modification to an approved sign program substituting yellow and orange illuminated
reverse channel letters for the approved coral illuminated reverse channel letters. The
project is located at 31888 Paseo Mercado de Capistrano in the General Commercial
District; and,
WHEREAS, the City has determined that this project is Categorically Exempt
(Class l la) from the California Environmental Quality Act; and,
WHEREAS, the City's Design Review Commission determined that the required
findings for Architectural Control approval could not be justified and thus denied the
applicant's requested sign program modification; and,
WHEREAS, the City Council hereby finds and determines as follows:
1. The proposed modification to the sign program is not generally consistent
with the goals, policies and objectives of the Community Design Element
and all other applicable provisions of the General Plan in that the
addition of bright orange and yellow to the approved color palette for the
Paseo Capistrano Center sign program, which consists of coral, ivory,
dark green and red, is contrary to the General Plan goal that all
accessory elements be compatible with the overall design of the
commercial development. The proposed yellow and orange colors
contrast too much with the pastel and dark colors of the approved sign
program for other Area A centers and are not consistent with the the
muted hues that are typical of the Mediterranean style that is utilized at
Paseo Capistrano Center.
2. The sign's yellow and orange colors are not in compliance with all
provisions of Title 9 of the Municipal Code in that the proposed sign
program modification is not consistent with the approved sign program,
which was established in accordance with Sections 9-2.306 (Architectural
Control), and 9-2.308 (Sign Review), nor is it consistent with the intent
of uniformity as specified in Section 9-3.606 (Signs) of the Municipal
Code which calls for sign programs to be uniform in design, scale and
color in order to insure the compatibility of a development with its
designed concept and the character of adjacent buildings.

The intent of utilizing the coral color for illuminated reverse channel
letters at Paseo Capistrano Center is that it will blend with the dark
green and the ivory colors of the small tenant signing as well as the tan
colors of the stucco and trim elements, whereas bright colors such as
yellow and orange, as proposed, would dominate over other elements of
the center. �.
THEREFORE BE IT RESOLVED, that the City Council does hereby uphold the
Design Review Commission denial of this sign program modification for the replacement
of yellow and orange color for the approved coral sign colors (Architectural Control
88-09).
