Resolution Number 92-1-7-6245 RESOLUTION NO. 92-1-7-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, INITIATING CONSIDERATION OF A GENERAL PLAN AMENDMENT TO THE LAND USE AND PUBLIC FACILITY ELEMENTS REGARDING PUBLIC AND INSTITUTIONAL SITE DEDICATION REQUIREMENTS FOR FORSTER CANYON PLANNED COMMUNITY (SAN JUAN CREEK ASSOCIATES/SAN JUAN MEADOWS) WHEREAS, the City has adopted a Land Use Element to the General Plan which establishes specific policies and objectives for the development of the Forster Canyon Planned Community, specifically with regards to the dedication of public use sites; and, WHEREAS, San Juan Creek Associates, project proponents for the San Juan Meadows project, have requested that the City Council initiate a General Plan Amendment to the Land Use and Public Facility Elements regarding dedication of an 8 -acre public use site and consideration of additional public uses for such property; and, WHEREAS, the Pacific Point/TMC project has been designed and approved to provide for the reservation of a potential public school site within the "country residential" component of the Pacific Point Planned Community consistent with the General Plan Land Use Map designation; and, WHEREAS, Section 9-2.102(a) of the Municipal Code grants sole authority to the City Council to initiate any amendment to the City's General Plan. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find as follows: 1. Local land use circumstances have changed significantly since the General Plan's Land Use Element and Public Facility Elements were revised in 1982 regarding the Forster Canyon Planned Community. Specifically, the Capistrano Unified School District (CUSD) has established specific facility design standards and the presently -proposed location for the public school site does not meet minimum facility planning standards. A school site situated at any location on the "Mesa" tract would not meet the minimum landfill setback requirements. 2. The recently -approved Pacific Point/TMC project includes a provision for reserving a portion of land for future dedication/conveyance to the School District for public school purposes. 3. The proposed General Plan Amendment possesses merit in that it could potentially address affordable housing needs in the community and would provide the City with the opportunity to re-examine long-term public se �!46 facility requirements and determine whether the senior housing is a more compelling public objective. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby initiate consideration of a General Plan Amendment regarding the Land Use Element and the Public Facility Element provisions for the Forster Canyon Planned Community.
