Resolution Number 92-5-5-2RESOLUTION NO. 92-5-5-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, VACATING THE EASEMENT FOR HIKING/EQUESTRIAN TRAIL PURPOSES WITHIN ASSESSOR'S PARCEL NO. 121-070-61 (31540 PEPPERTREE BEND/CHOU) AND QUITCLAIMING THE IRREVOCABLE OFFERS FOR HIKING AND EQUESTRIAN TRAIL PURPOSES WITHIN ASSESSORS PARCEL NO. 121-090-09 (31531 PEPPERTREE BEND/WISH) AND ASSESSORS PARCEL NOS. 121-090-12 AND -20 (31541 PEPPERTREE BEND/MOORE) WHEREAS, on the 6th day of December, 1988, the City accepted Irrevocable Offers of Dedication for hiking/equestrian purposes from Robert Wish and Raymond Camero (property now owned by James Moore; and, WHEREAS, on the 20th day of February, 1990, the City accepted an easement for hiking/equestrian trail purposes from Mr. and Mrs. Keith Powell (property now owned by Mr. and Mrs. Tom Chou); and, WHEREAS, on the 7th day of April, 1992, the Council initiated abandonment proceedings to be heard on May 5, 1992; and, WHEREAS, the City Council finds that the property and easements described herein are unnecessary for present or future uses as recreational trails by the City of San Juan Capistrano; and, WHEREAS, on the 5th day of May, 1992, the City Council of San Juan Capistrano heard testimony in favor of and against vacating said easement and quitclaiming said Irrevocable Offers of Dedication. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano as follows: SECTION 1. That the City Council of the City of San Juan Capistrano does hereby quitclaim the Irrevocable Offers of Dedication for hiking and equestrian trail purposes within 31531 and 31541 Peppertree Bend and vacates the hiking/equestrian easement along the northeasterly property line of 31540 Peppertree Bend, more particularly shown on Exhibits A, B and C attached hereto for reference. -I- 1 f - SECTION 2 That the City Clerk is directed to forward the Quitclaim and Vacation Deeds, attached herein for reference, to the County Recorder of the County of Orange.
